The daughter invited him in while the mom was out somewhere late at night with the 13 year old daughter by herself at the house after midnight, and the mom shot him in the back of the head when he was already outside the front door and leaving.
If she had shot him under the kid’s bed or in the kid’s bedroom when she first got in the house and let in to the kid’s bedroom this would be an easier self defense claim, but she can’t use self defense when guy was following her instructions and leaving. Depending on the state laws she might be able to get to a lesser homicide charge due to state of mind at the time, but marching him out the door first kind of hurts that.

Daughter should have left that part out. Dude was sick trying to frick a 13 year old but he was invited into the home and apparently tried to leave when the mom told him he was not welcome. This is going to end up being a murder charge unless there is more to the story that have not mentioned.

My thoughts exactly.
Speculating here. But I wonder if he instigated anything as he was walking away. For example, if he said something like "don't worry I'll be back, your daughter can't get enough of me". Or just anything vulgar about the child in general. I'm no expert, but I would think a good lawyer could definitely get her off in that situation.

By claiming a dead dude said something that can't be proven in court? You are indeed no expert.
If this is true than every murderer would use this as a defense. "Yeah they said they had a gun and would shoot me. No they apparently didn't have a gun and there's no proof they would shoot me but believe me".
And words don't justify a gunshot to the back of the head so no, not even close for your scenario.

The whole “shooting in the back = murder” needs to not be so black and white of a law. Each case should be evaluated independently based on the threat.
A man hiding under her child’s bed, escaping from a house occupied by two females is still a threat to them, imo. He could easily be trying to reach for a weapon while running away. Or leaving to go get a weapon and come back. She didn’t know if he was armed or not. She was protecting herself and daughter from him being able to come back and cause harm.
So if he was inside and turned >90 degrees left or right, it would have been okay to shoot? Kind of crazy to draw the line there..
If he was trespassing in their home he is a threat. Front, back, arm, leg, arse, dick…Shouldn’t matter. Hopefully she gets acquitted.

Yeah, theres killing an intruder actively in/breaking into your home and then theres finding one under your daughters bed, taking him outside, and executing him via GSW to the noggin.
