Totally disagree. Having sat on numerous court martial boards in the military, minority Officers and Senior NCOs will judge the merits of a case and dispense justice, if warranted, regardless of race. Often wondered why the military reflects society racially, yet has few of its moral, ethical, or criminal problems. The only thing that I can think of is that the military holds every individual accountable for his conduct.

Appeals based on denied Batson motions (the thing that lawyers do to allege that a juror was unlawfully struck on the basis of race) are virtually impossible to win.

I am a trial lawyer who has researched this issue in depth.

I wonder if potential black jurors disqualified themselves intentionally by some of their responses. If they vote to convict, they would definitely hear it from the community. If they vote to acquit, they know they are going to be accused of perverting justice and making themselves the center of a racial firestorm.

The Constitution does not mention a “jury of your peers.”

What it does guarantee is the right to an impartial jury. An impartial jury is made up of people who have no personal stake in the outcome of the case and no meaningful connection to either the defendant or the victim.

The phrase “jury of your peers” is often misunderstood. If taken literally, a person’s peers could mean classmates, teammates, coworkers, fellow church members, or others from the same social circle. That is not what the Constitution requires.

The goal is not to seat people who know or identify with the defendant, but rather to seat jurors who can fairly evaluate the evidence without bias, prejudice, or personal involvement. In other words, they have no skin in the game and can render a verdict based solely on the facts presented in court.

I will never forget the way the blacks were jumping up and down and acting foolish in celebration of OJ being found not guilty. We were in school watching the verdict on TV. That’s all the evidence I needed for a lifelong lesson.

Actually, it’s well-established that D.A’s in many jurisdictions do everything they can to eliminate black jurors. There are even “how to” seminars at D.A. Conventions…
