I have not looked at the SCOTUS arguments, but there is more than one way to skin the tariff cat if SCOTUS decides against the current status quo. I noted John Roberts, a Bushite, called the tariffs a tax. Meanwhile, the admin is talking about income tax credits due to tariff revenue.
