Reading between the lines...I'm guessing that the father passed and it went to the step-mother, and she passed it on to the step-sister.

I had a similar experience with my brother.

When my mom passed, there was 160 acres of prime Illinois farmland to be split between my brother, sister and I. My brother concocted this story that my dad had promised him 80 acres of it which was also our family home on it and my parents lived in it over 50 years. Of course, there was nothing in writing to back up his claim and my father was a raging alcoholic who could have said anything in a drunken stupor.

Fortunately, my mother was sharp enough to have her will written in a way that required 2 of the 3 of us to be in agreement on dividing up the assets. I feel sad for my mom knowing that before she died, she knew she had to protect my sister and I from my shyster brother. We ended dividing everything evenly between the three of us. I haven't spoken to my brother in 4 years even though we attended his son's (my nephew) wedding last fall. Couldn't even muster up a thanks for coming or anything to my sister and I. Mom was right.

That’s a damn shame
My sister was unfortunately the excutrix of our parents estate and was creating things in her head that was beneficial to herself and another sibling.
So I got the estate attorney involved and suddenly all these agreements she said existed verbally (there was a detailed will) suddenly disappeared.

Sorry about that. I try and remind my parents there are 3 of us and not to leave it up to us to fight over. Make it clear.

I predict that lawyer told OP that he has a portion of the estate he can fight for and the the land is 12 years in back taxes.

Correct. In Louisiana, absent a will, the stepmother would only have usufruct. After she dies, it would go to your father’s surviving children.

I’ve seen this many times where the surviving spouse tries to give assets to her family that they only had usufruct of. Courts shut that down instantly.

I know right...

Well. I will start here and you can all decide if I am telling the truth or not...

And the first thing that I want to say is Thank You Lord. I was going to post Ecclesiastes 3 verse 1-23 . - A time to get, and a time to lose; a time to keep, and a time to cast away;

I spent a few minutes with an Attorney in the other state which the property is located.

But I just sold my home that I have been living in for the past 25 years. BUt it was small and I now have an Old Lady, two cats and a Rootweiler. So the house was kinds getting small.

But the neighborhood has deterioted to a horrid level. With tweekers and crackheads running rampad all hours of the night. The cops are small town speed trap and homsless fyntnol users run amuck, thanks to a small church establishment that brings them in the area and then locks the doors at 8pm.

And my neighbor of the past 8 years living next door has no water, electric or sanitation. He enters the house by my bedroom window.. He was renting out his back shed to other tweekers and they would do meth and light fires etc... And the cops do nothing. I had to go to the State Fire Marshall..

I was worring about my Rott and cats, Tweekers watching me leave for work every day. Knowing when my old lady went to work.. When the Home and animals were alone... You couldn;t sleep at night because all the tweeker zombies.. My dog was going nuts all night.


So after a tire slashing incodent at a local business, I took video evidence to the cops who first turned it down and said they knew who it looked like.. Buttt....

And then I prayed what to do. And the Good Lord gave me this verse.

Matthem 2:13 And when they were departed, behold, the angel of the Lord appeareth to Joseph in a dream, saying, Arise, and take the young child and his mother, and flee into Egypt, and be thou there until I bring thee word: for Herod will seek the young child to destroy him.

So in the middle of the night I packed and Entire WWII Museum and Library in totes, and placed them in a storage unit. I rented a house that the Good Lord gave me and I moved my Family to a safer neighborhood. And we bough some new furniture from Goodwill and garage sales.

I then answered the first robo caller of - "Do you want to sell your property?"

So I said yeah.. and I do... ANd we closed yesterday.

Bt yesterday, I could not really talk to a lawyer because I had to get a trailer and two guy to help load everything out of my old shop of 25 years... I did it in 2.5 hours on a hot 98* day with bullsquash humidity.

And my life chapter was ended. I looked at a leather motorcycle vest.. Good shape.. Hadden been worn in quite a few years... I thought about keeping it but then it hit. I would just be wasting space and collecting dust. So I thought that 1: it didn;t fit nore more, I was 80pds less. 2. It had a Saints FDL on the back and I won't support the NFL. So I left it. Prolly had money in the pocket.

So the next day I took the trailer full of shop tools 150 miles south and unloaded them, and that's why I didn't have much time to talk to the lawyer.

But he said if my Dad didn;t deed over the the step wife while he was alive the property, I can file sometthing. Not Probate, but some heritage thing.

But wait. It gets even better!

I once made a thread here about my little Bro's house.

Long Story short.. My little bro died in 2008. My mother made a deal with a guy for lease purchase.. He lives until almost the last payment and then dies.

Guys Brother walks up to my mother about 4 years ago and says where my deed? She says, you still owe 3 more payments. Then nothing happens. For years...

OT said to not do nothing.

So as my home sale in tweekerville is taking place, I tell my Mother that my borthers place is selling at the same time. What a funny coincidence after all these years.

My home and my Brothers home sold almost the same day through totally unrelated events.

I sold for $45,000, His auctioned for $44,000...

Told you it was tweeker market...

But wait!

Today I got a call today. Looking for the relation of my brother whose house was still in his name. They say after a tax sale of $44,000, the state property taxes met and $40,000 is remaining. If my brother;s family does not claim it, it will go to the state in one year

County Auctions happen in June. and proceding are reviewing in Sept. And if I am the only living heir to my brother (Except our Mother) then that money will go to me in one year.

So I will open a case that he is my brother. ANd if nobody disputes the claim of home ownership, then it is better than going to the state... The ambulance chasing firm for this only wants 20%.

So that was my day today... I also have to call a title company for 4 acres of my Grandfathers. Lots of stuff to pick up. Sticks, Grass.. Lots of stuff..

Have not had time with the attourney.. and need propeorty details to a commercial broker. But I moved a trailer full of tools..

Oh.. and I sold my '48 Willys jeep... Post War Jeep. It was in pieces and this Home Closing was brutal.

This whole expeierence has been sad... But I am so Thankful for the saftey and Happiness of my family... it's like a whirlwind of events.

I just want to write movies and raise mules.

So thats the news. No time to talk to attourneys, Real Estate Brokers, Edward Jones.... Nobody..

I should draw a map for reference... Stop drinking and posting... So much so fast.. I didn't study real estate...

It is coming down to deed changes, but I don't have any hopes up. And I guess it makes no real matter.

But I am Thankful for your song... Third time today.

I want to keep the past alive, but I don't want to go back. I want to move ahead. I am so blessed...

Been there done that. Totally a kick in the gut. What makes it even worse, is the one who deceived you, was the one explaining how you were going to be taken care of, only to have her mother, with full on dementia, change things up to completely screw you over!
