Regardless of how you deal with it, from this point forward, anytime you can't find something, like your wallet, keys, toenail clippers, TV remote etc, IMMEDIATELY call your MIL and ask her where it is.

I don’t like the legal system and I don’t want to get the law involved. She’s selling her house right now and we’re talking about her paying back the credit card balance with the profit from the house.
1. It does not matter how you feel about the legal system. Your MIL lied to your face and behind your back for years.
2. You are talking about her paying it back. I doubt she plans on paying you back at all.

Bruh. That’s felony theft, monetary and identity. There’s no coming back from trying to frick over your own daughter like that. Let the bitch fry and stand with your damn wife.

This.
Newrow, does your MIL have some kind of substance abuse or gambling problem? If she knowingly spent tens of thousands of dollars in your wife’s name then I’d seriously be thinking about filing a police report. That’s sociopathic type behavior of her. I’m not joking either. What kind of mother would do something like this to their own child (rhetorical)? A shitty one. Not only her on child but her grandchildren as well. Doesn’t seem like she’s as stable as y’all might have thought. Maybe she’s having some mental issues arise. Either way, If I were you, I wouldn’t feel comfortable with her around my kids.
This could potentially wreck your wives credit. I don’t know what profession you’re in or how stable it is but you can’t just brush this off as “well, I make good $ and to keep the peace I’ll pay it off.” God forbid something happen and you and you’re wife can’t bring the income in like you have now, you’d be in a tight spot.

You need to work with MIL and credit card company to have her assume the debt and your wife clear of it. Credit card company can then get civil judgment against MIL and garnish her wages.
You're probably way more an expert on this than I am, but I was like 99% sure from all the reading I've done on this that you can't just "accept" someone else's debt without a police report. You cannot transfer debt to someone who stole your identity, even if they are a willing participant, without a police report.
There's always the small chance they take it easy on MIL if your wife says plainly in court, on police report, etc. that she does not want her mother punished.. but that's only a chance. Can't guarantee anything.
Either way, the debt is yours until you file a police report. And if you pay even a single dollar towards it, you assume the debt as your own.

I think if both parties agree it can be done easily.

She must be singing
"Got everything..
in my daughter's name.
But im hood rich"

I found your wife's response interesting. Usually, it takes awhile to get to this point, which leads me to believe that your wife has had to deal with your MIL's gambling problem in the past. You want to keep the peace in your family, back your wife.
Second, you indicated that your MIL was selling her house and would pay the debt off with the proceeds. Odds are she told you that to shut you up. How do you know she has any equity in the house that she can use to pay you off? Go to the court house and run her name in the mortgage records, I bet you find a few surprises. I would think that your MIL used up all the legal options to obtain money to gamble. Once that was used up she then engages in criminal behavior.
I would suggest you get advise from a specialist for gambling addiction on ways to handle this situation.

Ehhh I thought so too, but there was a huge thread on this on a money forum I read.. and everyone who posted this as a suggestion got a ton of replies saying no you cannot do it.
Obviously that doesn't mean those people are right either, but it was not just 1 or 2 people correcting them. It was a ton. They said transferring debt to someone who frauded you is not allowed, even if done willingly by both parties. You either accept the debt as your own, or you provide the creditor with proof of fraud (police report) before they transfer it over.
They know that someone stealing your identity likely can't pay the debt. They're not going to transfer the debt to someone who can't pay unless they are required to due to legal action against the person.

Experian Identity Theft. $9.99 a month.. Small cost to protect yourself..

I'd be surprised if mil has much, if any, equity in the home. If she resorted to stealing from her daughter, she likely used up all of her other options to get money. OP should be checking into her financial status.
Who knows if she opened other credit cards in other names?

9.99 for plus and 19.99 for the highest package.. What I like about it is you can "lock" your credit so no matter what you or anyone else is unable to open a new account in your name.. But yeah I get your point.

You can freeze your credit for free. The service maybe worth it for other reasons but I dont pay for locked down credit.

It costs about $60 to do that.

How to Freeze Credit for Free?
Just search the credit bureau name (Equifax, Transunion and Experian) and "credit freeze". Each one has a simple method on their website. You need to do all 3 separately.
