If proven by a preponderance of the evidence, it shall be an affirmative defense to criminal liability under clause (4) that the victim provoked the animal to cause the victim's death.

It’s a step below 1st degree if I’m reading the statute correctly.

Basically if you accidentally kill someone.
Like if someone kills someone accidentally with manslaughter, they are charged with 2nd degree.

No doubt she was a dumb bitch but resisting arrest is what sparked it. Both are in the wrong. Duante is as much to blame as the dumb bitch who shot him.

Why would you jump to this conclusion? Because of a very small amount of poor outcomes? It’s been used tens thousands of times successfully and may have saved hundreds of lives of cops and criminals.

Is this what they'd charge a civilian with if they accidentally discharged a firearm and killed someone? (And it can be proven it was an accident)

Just read above. It's negligence. That is a fair charge. This was outrageously stupid of that police officer and someone died as a result.
She might not get any jail time. It appears there is no minimum or requirement in that regard.
