I imagine it would be hard to prove she felt her life was threatened after admitting her intent to use less than lethal force, but there's a reason I am not a lawyer.

Normally these cop shootings are overcharged by a zealous DA which leads to an eventual acquittal. However, I think this one was properly charged.

Wouldnt the lawyer argue her negligence was being a dumbass and not purposefully grabbing the gun?

I think she already had the gun out and somehow forgot to holster and switch to the taser. Very strange. I’d love to hear her thinking.

Hypothetically, would she be in less legal trouble had she actually meant to pull her pistol and shoot the guy claiming she feared for her life?

Good. Police need boundaries. Seems like other like minded 2A Americans would share similar beliefs.

That is also assuming that the deceased person was simply minding his own business, correct? Like a driver wasn’t paying attention and ran over a pedestrian on a crosswalk.

My understanding is that is not what happened here. It is my understanding that the deceased person was doing something that rightfully required additional force from the LEO. The LEO mistakenly, according to her, used an inappropriate level of force.

She is definitely at fault; however, the deceased person would be all accounts be alive if he did not resist arrest. Is this correct? Is this the definition of man-2?

Couldnt the lawyer easily argue her fear of great bodily harm caused her to not be able to think straight?

I'd say if a cop has a gun pulled on them and their response is to tase the suspect, they probably shouldn't be a cop.

Man-2 appears to require the killer to also create the unsafe situation which is where she gets off on that one IMO.

Not disagreeing, but would the argument still be "she said taser so she clearly didnt fear for her life"

I mean, this is the correct charge, but I dont think its clear cut they win

I would assume it would be something like that if it went to trial, but I am not sure that would excuse the end result to the extent of acquittal.
