No it's not. Most states require the defense to prove by the preponderance of the evidence (or even higher with clear and convincing evidence) that there person is insane.
In Massachusetts, the defense merely has to present some credible evidence of insanity, then the state has to prove beyond a reasonable doubt that she's not insane.

At the only decent fish minger in Central Ohio they were selling "fresh gulf shrimp."

I think it's likely she kills herself given the chance. She's on the stictest suicide watch possible right now. That won't go on forever.

They were arguing that she didn't have psychotic episode or psycosis. Their expert stated he believed she had Bipolar 2.

It just shows how pathetic the prosecution is because they spent their entire case in chief talking about that, then they have their best expert witness come on the stand during rebuttal and say she clearly made a significant attempt at suicide and killed her kids out of delusional love.

I 100% agree with this as well and have said so.
In Ohio, you have to prove by clear and convincing evidence that you were NGRI.

Where I personally fall on this case is that:
- The prosecution didn't prove beyond a reasonable doubt that she didn't have any mental disease or defect at the time of the killing. And lacked the substantial ability to appreciate the criminality of wrongfulness of misconduct or conform her conduct to the requirements of the law.
- She killed her kids, in whatever mental state, and should never be free for the rest of her life. If she was ever released, this could happen again with whatever concoction of meds. It should never be allowed to happen again for her.
- I don't care if she rots in a prison for life, or goes to a mental institution for life. If she's ever released, that's a terrible miscarriage of justice. 100%, full stop.

Sidenote: The jury wasn't unanimous regarding the NGRI issue for Dahmer. It was 10-2.
