Yeah. Really sucks for that lady but it was an inexcusable mistake. She should plead guilty, serve a couple years, parole out and move on. Best she can hope for really.

CNN just showed a group of rioters crowded around LexisNexis and nodding their heads that the charge seems appropriate based on the statute. Sounds like they'll be going home soon.

Question here. Eventhough it was clear she meant to grab and use her taser, would than ultimately matter if the defense can prove or at least give reasonable doubt that she should have feared for her life and used her firearm instead?

Let me give just a clear cut example to show my point:

Suspect is pointing gun at cops, cop says "taser taser taser", pulls gun mistakenly, shoots the guy, and then freaks out and says "oh my god I shot him"

So you would still have someone who accidentally pulled their gun, but would that person still be guilty here?

Fair charge, IMO. Her negligence caused the death. She even admitted that she accidentally shot him.

I got my law degree from the same place I got my medical degree. Tigerdroppings and Twitter. It seems like she didn't consciously try and cause great harm or kill.

Yes. All of which he would have been charged with had she taser him and apprehended him. Instead she reached to the opposite side of her body, pulled out what she thought was a taser, didn’t notice it was a loaded 9mm, and shot him.

Yeh I wwant an actual lawyer to explain how the statute is supposed to be read

Because to me, she clearly didnt consciously mean to shoot him
