Well one of the reasons I voted for incorporation was getting our area back into the zoning say process.

BR is about to enter the FO stage. If the incorporation date becomes the election certification date, then many of the annexations that were done afterwards will be declared null.

Wealthy Family in Louisiana trying to sell land to a developer. Developer won’t buy because city hasn’t zoned the area for heavy commercial. Family throws a fit and tries to stop the cities incorporation efforts because they can’t sell the land at the price they want.

And it results in a lawsuit. Hence the beginnings of what we have here. This is a very grey area in the law….. Will St. George win…. Probably if they go full court but that opens them up to a lot of other issues they may not want to get into at the moment..
They have every right to seek whatever remedies they see fit to utilize since they are adversely affected… I got no skin in the game but only a fool would criticize the family involved for looking out for their own interests, especially considering many were against St George…

Fresh paint on the roads is nice.

If an incorporation date has not yet been assigned, the proposed incorporation date CANNOT be set retroactive or in past. The order date has to be "set forth" in accordance with La RS 33:4 or in future.
Future tense is used in the law - "shall become"
And the court can consider the Legislative Intent of the law, by the use of future tense in the verbage and the phrase "set forth" clearly indicates that a future date must be assigned for incorporation, not a retroactive past date in 2019 or even 2024.
La R.S. 33:4 -
E.(1) If the district court determines that the provisions of this Subpart have been complied with, that the municipality has the capacity to provide the proposed public services within a reasonable period of time, and that the incorporation is reasonable, the district court shall enter an order declaring the date the municipality shall become incorporated. The order shall set forth the name and the boundaries of the municipality. Unless this order is vacated by a timely suspensive appeal, a copy of the order shall be filed in the office of the secretary of state.
So once the courts determined this city was allowed by order of the Louisiana Supreme Court back in 2024, the next step should have been for the Louisiana Supreme Court to remand to lower 19th JDC Court to set forth an official incorporation date, and unfortunately that never happened. And cannot be done retroactively either due to legal problems this would create and has already created as evident by this lawsuit.
So even if an incorporation date is announced in future. Basically everything this city has done for the past two years and three months since April of 2024 is null and void.

The only reason this city barely passed with like 54% of the vote is because people wanted neighborhood control of the horrible public schools in and near their neighborhoods. And that will never happen, because the rest of the parish will always out vote CIty of St. George voters from being able to establish their own school district.
People did not vote for more government control of their property or the mandatory H.O.A. this city is quickly becoming. They voted for more control of their public school system.

Mayor Sid Edwards cannot lose the support of St. George Supporters, that is why he came out against the Baton Rouge Parish Attorney and Mayor Pro Tempore on this - to save face with City of SG Voters - who overwhelmingly voted for him.
Mayor Pro Tempore and Parish Attorney are positions that serve City of BR and EBR Parish, Not City of SG - so they are also doing what is best for City of BR and the people that put them into power.
