The lower courts were correct to deny the incorporation and in their assessment that this City of SG would have a negative impact on financial stability of City of BR while at same time unable to provide the crime fighting services it needs to provide for it's own city.

City of St. George has no court system and cannot afford to build a court house and hire the necessary people without significantly raising taxes. They have one employee managing their entire Clerk of Court for a city of 86,000 people.

Meanwhile City of Baton Rouge cannot afford to pay Hillar Moore or properly fund their District Attorney Office to prosecute hardcore criminals and prevent crime, while at same time provide the accused proper legal representation. City of BR cannot afford to properly fund the BR Police Department either.

The City of Baton Rouge should be filing for bankruptcy already. Not certain where the money is to fund the services they currently are providing.

DA is not a CITY office.

Also, the unincorporated areas of EBR (some of which is now St. George) was NEVER supposed to be paying for BRPD (or BRFD), much less funding their pensions.

You're making the same types of bullshite arguments that were made - and rejected - by the Supreme Court.

Riddle me this, if the Kleinpeters got what they wanted regarding zoning, would they still care about the incorporation date?

I wonder what the connection is between the Kleinpeters and the Parish Attorney? Friends? Political promises? Quid pro quo?

Amazing how many people are okay with an illegal taking of property without just compensation, violation of Kleinpeter's 5th Amendment Right is a violation of everyone's 5th Amendment rights. Whose property will be taken next? or rezoned against their will next?

A government should not be able to rezone and devalue somebody's property without justly compensating for the worth just devalued by the rezoning of that property to a lesser classification. And yes, I realize this has been done before in this Parish by that moron John Delgado when he rezoned industrial zoned tracts of property along the river against the consent of the property owner. But that property owner did not challenge that illegal taking to court like the Kleinpeters are doing.

You diehard City of St. George Supporters are like the sheep in Animal Farm, uncritical masses who blindly follow and conform to the ruling power without question. Cheerleader for the pigs taking over your rights and property.

I have read online that City of St. George code enforcement walks right into private backyards without owner consent. Also read where a contractor had to tear out $5,000 dollars worth of windows because it had a transparency rating of .26 instead of .25 - or something like that. People replacing broken wooden fence with new wood being stopped because they did not have a permit and had to pay like $300 for a permit to simply fix their own fence, even though it replacement in kind. Nightmares you hear about in strict H.O.A. busy body Karen-Type neighborhoods. Which is fine if you agreed and knew beforehand and chose to live in Nanny State Type Neighborhood with strict deed restrictions, but not ok if you bought in an older established neighborhood from the 1940s to 1970s without such regimented control of your property or even, like me a property that is located outside and not part of any neighborhood with deed restrictions.

Again: I am going to state the following because it worth stating:

If an incorporation date has not yet been assigned, the proposed incorporation date CANNOT be set retroactive or set in the past. The order date has to be "set forth" in accordance with La RS 33:4 or at a future date.

Future tense is used in the law - "shall become"

The court must also consider Legislative Intent of the law, by the use of future tense in the verbage and the phrase "set forth" clearly indicated in the law, a future date must be assigned for incorporation, not a retroactive past date in 2019 or even 2024.

La R.S. 33:4 -

E.(1) If the district court determines that the provisions of this Subpart have been complied with, that the municipality has the capacity to provide the proposed public services within a reasonable period of time, and that the incorporation is reasonable, the district court shall enter an order declaring the date the municipality shall become incorporated. The order shall set forth the name and the boundaries of the municipality. Unless this order is vacated by a timely suspensive appeal, a copy of the order shall be filed in the office of the secretary of state.

So once the courts determined this city was allowed by order of the Louisiana Supreme Court back in 2024, the next step should have been for the Louisiana Supreme Court to remand to lower 19th JDC Court to set forth an official incorporation date or set that date themselves - which never happened nor has happened yet, and cannot be done retroactively.

So even if an incorporation date is announced in future. Basically everything this city has done for the past two years and three months since April of 2024 is null and void.

City St. George is NOT incorporated, therefore is null, void and has no legal authority.

The city isn’t taking your land

As a developer you should know that timing is everything. You held the land for 100 years and you missed the mark on when you should have developed to make it what you want.

Now you want to throw a little temper tantrum and try to stop a city that most people want just so you can make $20 mil instead of $18 mil on your development.

Yes. They took value from that land by rezoning it to a lesser classification. If the government devalues your property, they need to compensate you for it. That is an illegal taking.

Devaluing a property from $20 million to $18 million is $2 million.

City of SG owes them $2 million if they want to rezone to a lesser classification that takes $2 million.

I don't know about you, but for me, losing $2 million is alot of money to lose.

And I don't want your sympathy.


I want property rights restored or justly compensated for the taking from an individual if it is necessary to provide for the greater collective by government.

since they were overturned by higher courts, they obviously were incorrect in their denial of incorporation.

incorporation of StG should have noting to do with effect to the city of BR. they are separate city entities. parish government on the other had could impacts but those would be no different then Baker, Central, Zachery, that are all already cities within EBR parish. so nothing new here

Then they should have sued for that. They didn't.

Instead, they are trying to argue there is no city. Serving as a stalking horse for the same butthurt losers that lost the election and the case at the Supreme Court. This time, with the PARISH attorney involved, which is an inherent conflict of interest since the residents of the City of St George are citizens of East Baton Rouge Parish (i.e., his clients).

I was just coming here to post this. Huge conflict of interest for the Parish Attorney to get involved in a dispute between a city within the Parish and a private individual.

The Parish Attorney office should be investigated. Friends with the Kleinpeters? Quid pro quo situation?

The DA of EBRP is given money by the State to run the office. They all are. Course each Parish can supplement the State money if they so choose. We chose not to by voting down that abortion called “Thrive”.

Is it too late to have property annex to City of BR if City of SG is not incorporated yet?

Metro Council Representative John Delgado led a crusade to annex as much adjacent property to City of Baton Rouge before the incorporation of City of St. George could include those properties.

Since Incorporation has not happened yet. It is not too late for property owners adjacent to City of Baton Rouge wishing to now escape this City of St. George to now annex their property to City of Baton Rouge?

Technically these property owners can still annex their property without approval from City of St. George, since it is not incorporated yet and has no legal authority and an incorporation date can not be declared retroactiviely or in the past because the way La R.S. 33:4 is written the date "shall be" declared and the boundaries "set forth" - uses future tense.

Technically the boundaries have not been incorporated yet - meaning all of proposed City of St. George is still legally unicorporated.

Is the LRK LLC Property adjacent to City of BR? because if so, they should be able to annex to City of BR and escape City of St. George. And this would go for any other property owners wanting out of City of St. George before it too late.
