Black members of Oklahoma Native American tribe file federal lawsuit to gain citizenship rights

quote:

Two descendants of Black people once enslaved by the Muscogee Nation filed a federal lawsuit in July 2026 to force tribal leaders to issue their citizenship cards, following a prior tribal supreme court order. Plaintiffs Rhonda Grayson and Jeffrey Kennedy named Principal Chief David Hill and the citizenship board in the U.S. District Court in Oklahoma City.

Background and Prior Rulings

The Plaintiffs: Rhonda Grayson and Jeffrey Kennedy, representing Black Creek Freedmen descendants.

The 2019 Denial: The tribal citizenship board rejected their applications, claiming they lacked a lineal native ancestor.

The July 2025 Ruling: The Muscogee Nation Supreme Court ruled that descendants of Creek Freedmen are legally entitled to tribal citizenship under an 1866 post-Civil War treaty.

Current Federal Lawsuit Details

The Delay: Principal Chief David Hill blocked the citizenship board from issuing enrollment cards, waiting for constitutional updates.

The Core Claim: The July 2026 federal complaint argues that withholding the cards violates the 1866 treaty and ignores the tribe's own highest court.

The Tribe's Position: The Muscogee Nation maintains that internal governance and constitutional matters must be handled through tribal institutions rather than external federal courts.

Got to get a share of that casino money somehow

Is there even a jurisdiction you can file suit in for this sort of thing? I thought the tribe had final say and its not a matter of law.

Reservations should be abolished. The whole thing is absurd in modern times. They are all hell holes.

Only tribe worth pulling this shite to get into is the seminoles.

They're legally entitled to tribal citizenship. It's a legitimate lawsuit.

Looks like the lawsuit is for mandamus to force the citizenship board to issue the citizenship enrollment cards.

Why?

The courts already ruled that descendants of Creek Freedmen are entitled to tribal citizenship. If they're still being denied that, why wouldn't they sue?
