Im interested in yalls opinion on if stand your ground applies after you have advanced/escalated the confrontation. If she did in fact exit the car gun in hand after the confrontation had already initiated, is she standing her ground or is she now the aggressor?
I guess thats probably the bazillion dollar question and also what I was getting at with my earlier comment about shooting someone in my own yard. Does the SYG argument lose merit if you were offensive at any point or is it a score type thing, she 10 defensive things and 2 offensive things so therefore she was standing her ground?

The longer video starts at the point of her getting out the car with the gun after they had the argument over the spot. She was clearly
Irate with gun at her side. The man walks up and you can see him stumble back once the woman raises the gun so I dont think he knew she had the gun at that point. The van then leaves. Then we see him following her and whatnot.
Audio of what happened is gonna tell the story.

Now, FL’s SYG law doesn’t require retreating, but it also doesn’t apply if you were the aggressor, which the above appears to paint her as.
If what was posted above is true, I no longer believe she acted in self-defense.

For your example, you would go to prison as you have no “imminent bodily harm or threat to life or limb” component if someone is simply yelling at you from your yard.
Now, if he forced himself into your home, sure.
If you went on your porch and stood there watching and waiting, you could make the argument if they moved aggressively towards you, but that just gets murky and a jury could still frick you, IMO.

Bingo. Stand your ground means you don’t have a duty to retreat in a self defense situation. It is not its own thing.
There’s 4 factors of self defense:
1. Innocence: you can’t start the fight. Who knows who actually started the argument, but, her getting in her car, then, getting out while brandishing a gun will lose this factor for her. Based on what’s known, she escalated what was a verbal spat to a life or death spat with a gun involved
2. Imminence- Is the deadly force threat happening or about to happen? I don’t see it. Was the guy following her? Yes. Was he being an A%&? Yes Was he ready to kill her or threatening to kill her? I don’t see it. He didn’t pull a gun, he didn’t pull a knife, he didn’t even ball his fists like he was going to punch her. He never touched her.
3. Proportionality - You can only match the force used against you in self defense. He was following her and talking trash. A response to that isn’t shooting him! Again, at no point did he touch her. Details matter, a lot in self defense cases
4. Reasonableness - she was in her car, a safe place, also part of the castle doctrine. Got out of it with her gun drawn to confront a man approaching her. Not what a reasonable person would do.
As I see it, she fails on all 4 factors. Prosecutor only has to prove 1 factor did not exist to get a conviction.

I am going to guess that the audio during this whole sequence is going to make things a lot worse for her…
Also looks like they were fighting over a parking spot. I see signs in the video was it a handicap spot? The man seemed to walk funny was he disabled? Was she one of those people that thinks they are entitled to a handicap spot or did she have a disability also? All going to be interesting pieces to the puzzle.

As anyone can see from the video, he is unarmed and slowly and barely even took a step toward her about a car length away and she shot him.
After he is shot she looks to be shouting and pointing at him as he is bleeding out from a gut shot.
How can she be walking free and not charged with cold blooded murder?

Also, there is probably a dying declaration from the victim. Think the article says he was transported to hospital but didnt survive.
