His comment was in regards to the use of “unarmed” as to why a shoot can’t be justified.
Whether or not a person is “unarmed” can be taken into consideration, but you can very clearly be justified in the shooting of an unarmed individual, even when not being actively physically assaulted.
An example was the case involving the food delivery driver and the YouTuber.
The driver was simply picking up food when the YouTuber started walking up to him playing weird things on his phone. YouTuber never spoke, just kept walking up to him playing vulgar phone messages.
Guy feared for his safety, shot him, and was acquitted.

quote:I guess you don't. If your intention is to shoot someone. Just know that brandishing a weapon is not the same as drawing a weapon. It has sinister implications.
How do you shoot someone without brandishing a weapon?
quote:
Brandishing a weapon means exhibiting, waving, or drawing a deadly weapon in an aggressive, rude, or threatening manner to induce fear.
This broadly includes intentionally showing a firearm or lifting your shirt to expose a concealed weapon. Legal consequences and specific definitions vary significantly by state.
Brandishing is assault. Based on the video, her actions were aggressive. She unlawfully displayed her weapon to intimidate or threaten the guy.
Remember, I said he's a dumbass for what he did, but she's still likely to be charged.

That's murder. Just walking towards someone while unarmed doesn't qualify for Florida SYG.

If this is true, I reverse my position.
This is not SYG or self-defense.
I don't think a partial witness statement is enough to make me reverse my position quite yet. The witness statement does not negate what we saw in the video. If you keep reading, the witness statement actually matches pretty closely to what we see in the video:
quote:
Moments later, Diguglielmo is seen walking up to the woman. She points a gun at him, but for at least the first 30 seconds, they appear to speak to one another.
Video shows the woman telling Diguglielmo to “walk away.”
Diguglielmo, however, is seen following the woman as she walks around another car while still pointing her gun.
He does appear to walk away but immediately returns, leading the woman to open fire against him.
All this time, as the video shows, the woman is on the phone.
As the man falls to the ground, they keep exchanging words, but the witness said it’s unclear what they’re saying to each other.
Trying to piece it all together, it sounds like it went something like this:
1. Man blocks woman from pulling into a parking spot.
2. Man moves car allowing woman to park. Woman parks and exchanges words with man (and possibly other occupants).
3. Man presumably parks his car somewhere else then approaches woman.
4. Woman pulls a gun and tells man to "walk away."
5. Man continues to advance towards the woman while she retreats.
6. Man walks away, but then turns around and approaches woman again.
7. Woman shoots man.

After figuring out the timeline, which wasn’t obvious the way the video clips have been released, the guy had blocked her with his car for a few minutes, not allowing her to pull into the spot.
I assume there was an argument and heated antics during the time he was blocking her parking spot.
He then moved his car and she pulled into the parking spot.
After she parked, she exited the car with the gun in her hand. She was not pointing it or waving it. Just holding it down by her side. She began talking to the people in the car next to her.
The guy then approached on foot. He wasn’t moving fast but sort of assumed a bulldog posture and walked towards her from maybe 5-10 feet away.
She pointed the weapon and the other vehicle pulled away. He continued to bulldog slowly towards her and she retreated. He bulldoged her the whole time as she retreated into the next aisle and then around a car. Mind you, she’s walking backwards, gun trained on a guy bulldogging her just a few feet away.
He, at some point after she retreated around vehicles, and he seemingly walked away.
I don’t like how she then used her car as a rest and continued pointing the gun at him as he walked away, but in fairness, he was still mere steps (3-5) away.
This is where the man’s genius really shines through. He turns around and starts bulldogging her again. This time she doesn’t retreat. He gets within 2 steps from her and she placed one shot center mass.
She places the gun on the car and dials 911.
Any reasonable person could see he was the aggressor.
Any reasonable person could accept she was in danger of serious harm.

So you’re saying she was in such fear for her life that she exited her vehicle anticipating that this man would harm her?
If that’s the case. You don’t get out of the car.
You can’t intentionally put yourself in a position where you fear for your life just to shoot someone. She had every opportunity to flee. She has no stand your ground case whatsoever
Guilty

She exited the car before the man approached her. She's entitled to get out of her car. It was only after she exited her car and the man continued to advance towards her after she pulled a gun and told him to walk away that she is likely reasonable to fear for her safety.

This is why the audio is going to be so important. If she was afraid she wouldn’t have got out of the car with a gun. We don’t know what was being said but it is very plausible that she continued the argument once she got out of the car and that was the reason the man came back. IMO he didn’t know she had the gun because you can see his reaction where he stumbles back once she raises the weapon.
Both very dumb people. What was the guy saying? When he pulled away did he say he was coming back to hurt hit or anything? All of this is going to matter. If the guy was making threats and shite I don’t have a problem with the shot.

They are both dumbasses and unfortunately, someone lost a life over a parking spot. Absolute stupidity.....

For the down voters.
Take the gun out of the equation.
You’re there with your wife, girlfriend, daughter whatever. She is talking to someone parked next to her parked car when a man she just had a heated argument with comes around the front of that car and starts walking towards her with an aggressive posture. We’re talking like 5 feet away and he’s bulldogging towards her.
Nah. That’s go time. No more talking. It’s going violent 100%. No if ands or buts about it.
Her retreating only shows she was in fear and didn’t want to shoot.
His continued bulldogging only shows he was without a doubt, a very dangerous person.

This is America, nimrod. She was free to get out of her car.
She was talking to the people in the car next to her, who saw the whole argument. She wasn’t waving the gun around but was ready in case the guy approached her and he did. He didn’t simply walk by on his way into the store. He turned and bulldogged toward her when she was still between the two parked cars.
I agree he probably didn’t see the gun because she wasn’t pointing it or displaying it. But guess what, she did have a gun in her hand when the guy closed in on her.

The problem for her will be she exited with the gun drawn. If she was in fear enough to draw the gun, then why would she exit the vehicle.
The timeline of when she called 911 will come into play also. Did she call while in the car? If she did, I'm sure they would have told her to stay in the vehicle until LEO arrived. If not, once again it opens her up to why she had the gun drawn and exited the vehicle.
We lack too many details to come to a legal conclusion. All we have enough to do is guess.
It does serve as a reminder to avoid situations like this like the plague. Laugh it off and go about your business.

Ever wonder why 14% of the U.S. population is responsible for 90% of violent crime?
There is not a single area on this planet that they make better in any capacity. When I hear of people complaining that things are more expensive in stores, then complain about the companies ripping us off, I hate it. They are ignoring that people steal billions and billions from these companies. They are not going to just eat these costs. Also insurance is going up exponentially. Why? Look at all of the vehicles on the road that are damaged. Why are they on the road and damaged? Because they don’t have insurance. Insurance companies know how many people are around you that don’t have insurance. That’s then factored into their cost for you.

I didn't dv but you are probably getting them because you are making way too many assumptions and acting like you have a clear understanding of what everyone's motivations were.
For instance, him "blocking" her for a few minutes. We have no idea of what actually happened. maybe he parked in the space, and she was throwing a fit and he finally said the hell with it a moved so she could have the space to try to end the crap. Or maybe he was actually blocking her and acting like he was going to ram her. We just do not know.
She should not have exited the vehicle with the gun drawn. If she wasn't in fear, then don't draw the gun. If she was then call 911 and sit tight with the firearm ready until LEO arrives.
We have no idea what his motivations were either. Was he threating to break her neck or was he saying her pulling a gun over a parking spot is retarded?
Guessing and proposing what if is fine but too many on here act like they know enough to give an opinion with any weight and no one does right now.

quote:anyone who watches the unedited version can clearly see the difference between between using a weapon to save your life and trolling a mfer with a gun while being an equal participant in a verbal altercation. She didnt like the argument and got mad/brave at the same time and emerged from her car with a weapon, continued to escalate along with the man, their arguement then she shot him. The woman is guilty of killing that man. End of story. Call the man whatever word for being stupid because he was definitely stupid for continuing to argue with another person who was pointing a gun at him.

To many dumbasses here who watched the edited version and made dumb arse judgement call just like she did.
Eye for eye. She had a weapon, he didnt. She is guilty. A smart jury will convict her.
