If you’ve had a sip, never blow or take the field test. Never admit you’ve had a drink. Never admit you were somewhere where there were drinks.

You only have the right to call your lawyer when you're (1) under arrest, and (2) being questioned, either roadside or at the station. Anything you say before arrest is gratuitous disclosure.

Based on the one leg stand alone I’m letting him off. She kept the test going until he failed.

And are we supposed to believe that the nearest level ground was the booking station?

He probably had a few, but not enough there to convict.

Depends on the state here, implied consent laws will result in harsher penalties for refusing and they will still draw your blood and give you a DUI.

I’m obviously no legal expert, but why isn’t he allowed to contact his attorney when asked if he will take a field sobriety test? Seems like a reasonable ask…like “hey, coach, should I do this or are they just going to use baseless subjectivity test to convict me?”

Seems like that request should be granted.

To be fair, she was asking him a shite tons of questions, he asked to call his attorney, she said step out for arrest.

Ummm, incorrect. You can legally deny a breathalyzer test in any state.
It may come with consequences (implied consent laws etc.);
but you can absolutely, legally, deny a breathalyzer test in every state.

You automatically lose your license (for a period of time) in some states if you refuse. Also, they can get a warrant and force a blood test if there is a serious incident (such as a crash).

This is called implied consent - you agree to these rules when getting your license. SCOTUS has upheld these laws.

Clearly had been drinking. He talked way too much.

I had a buddy get picked up for it and while he followed instructions about license, get out of the vehicle, etc., he literally never said a word. He hired some big shot attorney and walked. The attorney told him that was the best control of emotions, talking, he'd ever seen.

I'm guessing the warrant for the blood draw is going to frick him. That's relatively new.
