Of course it has not been determined and of course it will be up to the court (a jury, probably) to decide, but of course no intent to commit murder will also be his likely defense.
Unless these witnesses testify hearing him use words that reflect an intent to murder (possible), I don’t think the duration of an arse whoopin is enough. We probably agree 5 minutes is a long time to wail on someone, but not if the goal is to keep him down until the cops show up.
Average Joe is judged by lower standards than average cop. Average cop gets convicted of murder in this scenario. But average Joe probably gets probation.

Guy is standing in a parking lot, presumably not in a big throng of people. Another guy asks him for money and he tells him to frick off. Then the other guy somehow ends up with his wallet.
I see some have painted this as some sort of 'pickpocket' incident, but the above scenario, makes it hard to see it as such and not the beater guy somehow getting 'attacked'. Otherwise, how exactly did the thief guy come to get a hold of the guy's wallet?

I've had my car broken into, I've had my home in Mid City burglarized and I wanted to do this to the perpetrator each time. I'm glad a crook got caught and I'm glad a crook is dead. Frick the crooks; this guy is a hero.
If I am on that jury, I would make sure he is not guilty, or at the very least, a hung jury.
