i want to be on the jury, he will be not guilty and i will beat the shite out of anyone on the jury who doesnt agree

this man clearly suffered enough from being robbed and doesnt need to go to jail, call it victims rights to dispatch justice

A coroner’s determination of homicide is not the same thing as a criminal charge.

He has thus far only been charged with misdemeanor assault. He was also released on his own recognizance (not forced to pay cash like the white dude in the OP).

You had me until this stupidity. Intent to kill has not been established. Intent to deliver an arse whoopin is pretty clear. What court will not support the right of a victim to react with an immediate act of retaliation when there’s no intent to murder and the average person has every reason to believe an arse whoopin has a very high survival rate?

As far as I know that has yet to be determined and is going to be up to the court to decide.

All I'm saying is that this guy shouldn't have taken it to the point where this is even a question. Want to give the thief an arse-whoopin, go ahead, but beating him to death is a bit much IMO.

I’m curious to hear more details.. if it was a 5 minute brawl after he wrestled his wallet back then I’m on the side that he should walk free. But that’s not the picture the article paints:

Set a timer for 5 minutes and then think about kicking someone on the ground for that long. It’s a LONG time to be beating someone. That sounds like a textbook example of manslaughter...

I get the response that this guy shouldn’t be punished for being a victim. But someone who snaps like that and kills a man curled up on the ground is not innocent, regardless of whether the thief deserved an arse whipping. Reminds me of the scene from American History X.

They don’t necessarily need to prove intent to kill since he’s charged with manslaughter.

And an immediate act of retaliation =/= kicking a guy in the fetal position for 5 minutes while two people try unsuccessfully to pull you away. Nor do those actions reasonably lead to a “very high survival rate”...

From what I've read it doesn't sound like the thief was ever attacking him, so I don't think that defense is going to work either
