i want to be on the jury, he will be not guilty and i will beat the shite out of anyone on the jury who doesnt agree
this man clearly suffered enough from being robbed and doesnt need to go to jail, call it victims rights to dispatch justice

He has thus far only been charged with misdemeanor assault. He was also released on his own recognizance (not forced to pay cash like the white dude in the OP).

I can argue that very point every which way as a matter of fact.

Sure, and according to our laws you would be wrong.

You had me until this stupidity. Intent to kill has not been established. Intent to deliver an arse whoopin is pretty clear. What court will not support the right of a victim to react with an immediate act of retaliation when there’s no intent to murder and the average person has every reason to believe an arse whoopin has a very high survival rate?

On one hand, a serial thief. On the other hand, a pothead who beats up women (or gay men, who knows)

Duncan received a two-year prison sentence in October 2008 after pleading guilty in Orleans Parish Criminal District Court to purse snatching, records show. A week before his death, Orleans Parish prosecutors had dropped a simple burglary charge against him. He was due in court this week in connection with a separate felony theft charge.

As far as I know that has yet to be determined and is going to be up to the court to decide.
All I'm saying is that this guy shouldn't have taken it to the point where this is even a question. Want to give the thief an arse-whoopin, go ahead, but beating him to death is a bit much IMO.

WTF argument is that?
I think we can agree that I value life differently than many others and I have no intent on testing the limit.

Like others have said, if he had punched the thief and made his head hit the concrete, that’s one thing. But he wailed on him for 5 minutes. At some point the thief was unconscious and he kept beating him. It’s pretty messed up when you think about it.
+1
I’m curious to hear more details.. if it was a 5 minute brawl after he wrestled his wallet back then I’m on the side that he should walk free. But that’s not the picture the article paints:
quote:
Morris caught up with him in the rear driveway of Hi Class Customs, an upholstery and window tinting shop at 4201 S. Claiborne. Morris wrested his wallet back and then began beating on Edwin with his fists, police said.
At least two people tried to restrain Morris. But he kept punching and then started kicking Edwin, who “was begging Morris to stop and was attempting to cover his face and body,” police said.
Sounds like the thief was curled up in the fetal position while Morris kicked him, despite two people trying to pull him off, for 5 minutes. Set a timer for 5 minutes and then think about kicking someone on the ground for that long. It’s a LONG time to be beating someone. That sounds like a textbook example of manslaughter...
I get the response that this guy shouldn’t be punished for being a victim. But someone who snaps like that and kills a man curled up on the ground is not innocent, regardless of whether the thief deserved an arse whipping. Reminds me of the scene from American History X.

They don’t necessarily need to prove intent to kill since he’s charged with manslaughter.
And an immediate act of retaliation =/= kicking a guy in the fetal position for 5 minutes while two people try unsuccessfully to pull you away. Nor do those actions reasonably lead to a “very high survival rate”...

Does Castle Doctrine / Stand Your Ground apply here? The wallet is his possession.
I would think not, but who knows?
