Negligence per se.

Under South Carolina law (S.C. Code Ann. § 61-4-580), it is illegal to knowingly serve alcohol to any person who is intoxicated.

In cases involving violation of the dram shop statute, like this one, the plaintiff will argue that the defendant is negligent per se for violating the criminal statute. The plaintiff merely needs to show the defendant violated the dram shop statute, the violation was a cause of the accident, and the accident caused the damages, in this case, the death of the bride and the injuries of several people.

The golf cart was thrown 100 yards. Miller died at the scene, still wearing her wedding dress. Hutchinson survived with a brain injury and multiple broken bones.

Tell it to the state legislature. Most states have Dram shop liability statutes to specifically force the responsibility to not over serve on the server because, and this may come as a shock to those commenting, drunk people make bad decisions.

I personally view myself as holding a mix between conservative and libertarian views, and I don’t understand how the people here, many who are conservative, have a problem with businesses incurring financial penalties for over serving alcohol when they make money selling the same alcohol. These penalties are mechanisms to reduce the amount of people that are over served so less people and families are harmed by drunk drivers.

Lots of jail for a DWI? Jesus dude, get off your high horse. There are tons of people that drive that are “legally” over the limit. A couple glasses of wine at dinner might be over..

This is why all the small breweries and bars in SC are shutting down. The person responsible aka the driver, has her insurance pay the max on the policy and then the deeper pockets foot the rest of the bill.

Liquor liability has become unaffordable in the state and is resulting in major issues for the small restaurant and bar. While this jackass driving is the problem, I don’t see why the bars have to be held negligent for another individuals act of stupidity. No money will ever bring back his wife. This whole state is going to run into some major drinking problems soon if they don’t get this fixed.

Not the same. A closer comparison would be a gun salesman who sells 6 more guns to a person they just witnessed them mishandle a firearm on the way in the store and shoot off some close call warning shots.

The lady was clearly intoxicated and then over served at three different places.

Because to most conservatives, personal responsibility holds more weight.

Do you also feel that fast food establishments should be sued for serving the obese and contributing to their poor health?

Enterprise has liability insurance on all of their vehicles when you rent them. They are either primary are excess based on jurisdiction In any case Progressive paid the limits and Enterpise paid their limits. I’m guessing they paid out the limits early which ended their duty to defend.

Turns out, all drunk people are really high on a low quality drug that much of this country thinks is fun to abuse while vilifying actual good drugs.
Do they have car insurance? If they are here illegally my guess would be no. They should not be driving at all.
