McDonald's shouldn't be held responsible for selling people food, just like bars shouldn't be held responsible for selling people drinks. That's the entire reason these businesses exist.

This could not more possibly miss the point. I could not care less if the drunk driver kills his or herself because some bar owner didn’t properly train his or her people, but I, and most normal people, care if the driver kills someone else.

To put it more clearly, the fat person is only hurting the fat person, not some random stranger by driving 65 in a 25 while so intoxicated they don’t think they are doing anything wrong.

Three people that upvoted your comment lack analytical skills.

To make a profit? Yea, so do pharma and vaccine companies. The fact that you cannot make the logical discernment between your fast food hypothetical and this situation is mind boggling

If the fat person is going through the drive thru and then a mile away drops a fry on the floor of the car, gets distracted trying to pick up the fry, and gets in a car accident with a fatality, should the fast food place be held liable for the death for selling food to someone in a car?

I said before that I don't know the details of the case, and if she is on camera obviously drunk and belligerent and still got served, I am fine with claiming the bars and restaurants were negligent.

I've never worked in either and maybe there is specific training and all for the telltale signs on when to stop serving someone.

When does the negligence start in cases like this?

Okay this is a more reasonable conversation. I’m unsure about SC’s specific criminal statute (SC does not currently have a dram shop statute) but I am not for strict liability. My personal opinion is there should not be liability unless evidence exists that shows the server was on notice or that clearly shows the server should have been on notice, but chose to serve anyway.

In Texas there is a duty of care imposed to take reasonable steps to avoid the patron becoming overly intoxicated.

This is where I am at, as well.

I just got a little extreme with my examples in being on side of businesses, haha.

Bar found partially responsible for Plano, TX mass murder

But the chick was smashed drunk… any bartender should have been able to see this. Unless somebody else was bringing her drinks. This chick should have found a different way
Home.. it’s a simple fact. 25 years is not enough. And I wonder how many times she got shitfzced snd drove anyway and just got lucky.

The effects of alcohol aren't always immediate and noticeable.

She very well may have been smashed drunk and still served, but in some very brief Googling, I wasn't able to find any more details on the state she was in at each of the 3 bars and restaurants included on settlement.
