What useless panic these insurance companies put people through just to get out of paying.
When I went through a similar thing here in Alexandria, Louisiana, I was losing my mind until I found a lawyer recommended by a local friend.
These guys do not mess around with insurance companies and they take away the stress you are in right now.
Talk to the right people in your area. Check Roy Injury Law.

Don't stress too much, Progressive's lawyers send those standard warning letters to cover their own bases. Since it's been a couple of months, did they end up settling within your policy limits?

Generally, the claimant has the burden of proof. However, that is not a high bar. It just takes one medical opinion to say the accident was the cause of injury to meet that burden. The defense then has to submit evidence countering that opinion. Then it’s up to the judge or jury to weigh the evidence and make a decision. This is why these kind of cases always settle, and they generally settle within policy limits.

Also, wrist surgery is generally not that expensive. Not counting the preliminary work-up and treatment, the $6,000 quote was not far fetched at all, including PT. All together it’s probably under 12-15k total medical. Problem is what may come from that. Loss of income, permanent impairment, pain and suffering, etc. A plaintiff attorney will probe for all of it, especially considering surgery is involved. Fortunately, a good insurance company will also have experienced attorneys. Again, this why these always settle.

PI attorneys lovvve limits being raised because that’s easy money.
Every time we minimum liability legally goes up or people up their coverage thinking they are protecting themselves. pi attorneys bank more money. The amount of people that actually get sued for more than their coverage, stays the same

The insurance company always sends you a letter informing you that the case could possibly be worth more than your insurance limits. The percentage of cases where plaintiff attorneys actually proceed for excess judgments against people is minuscule. I wouldn’t lose too much sleep over it. Just hope the insurance companies handle it which they probably will.
