Daughter was in a wreck, insurance and compensation question

Daughter totaled her car and was at fault. The person she hit had minimal damage to bumper of his truck and drove away unscathed supposedly. Acadian ambulance was never called to the scene. We now get a letter from progressive, our insurance, that the person involved is recommended for wrist surgery and that if the amount needed to cover the damages, could come out of our pocket. How screwed am I? My daughter is distraught about it and don’t know what to think.

How shitty is your insurance coverage? Did you do minimums?

Yeah if you have some net worth they can and will go after you for more if you have low limits

Also your premium on her is about to at least double. Needs to get a job to contribute

How old is your daughter and if over 18 is she willing to pay this dude in the more historically conventional currency for debts like this?

First of all, that sucks.

Secondly, 99.9999999999% chance the other lawyer will ask for whatever your limits are and that’s it.

Nah. 99% of the time PI lawyers are too lazy to do this. And in that sliver, it’s typically because the defendant has obvious assets, ie they’re rich.

Your insurance will low ball, they will send threatening letter talking about if they give the maximum of policy then that will satisfy the claim or else they may go after you.....its all BS. They won't come after you and eventually, if they have legitimate medical proof your insurance will settle and you will be fine (other than the rise in premiums)

This^^^ it will settle within the limits of your coverage.

Appearance of injury at scene is irrelevant. Any injury that manifests within the next year and a Dr is willing link to the accident under oath will be used to get money from your policy.

Even then, it’s up to the OP’s insurance lawyers to prove the injury was NOT related to the accident, which is even harder to argue most of the time.

You are learning first hand why plaintiff attorneys are scum. Please continue to educate everyone you know.

LSU and other schools/sports teams should shun them and refuse to take their blood money.

She messed up big time.

Can't believe you did not teach her a basic rule.

When the wreck is your fault, you do everything to insist that the other person leaves the site in an ambulance. That way they can't come back and fabricate injuries just like what you're having to deal with here.

NO. He;s learning first hand that only idiots carry minimum or low limits to save a few bucks, when they live a split distracted second away from losing everything and bankruptcy
