It’s a form letter intended to CYA for the insurance company in case they fight the settlement demands, go to trial and have a verdict in excess of your policy limits.

Unless you carry minimum limits, don’t worry about it. Also, if your daughter is over 18, you are good to go, she is responsible, not you and she likely has no assets of any significance.

I’ve had plenty of cases where someone is discharged within hours at an ER and still manage to incur six figures of Plaintiff’s doctor meds. The best thing the ER can do is rule out acute injury like a broken bone.

The letter was probably to advise you that Progressive will only defend you up to the liability limits of your policy, so you may need to hire another attorney to defend for any excess exposure. It’s their duty to inform you of that. They may offer the liability limits to the other driver in exchange for releasing your daughter from further action. The adjuster should be able to tell you if that’s already been offered. Hopefully, the other driver has uninsured/underinsured motorist coverage and will use that coverage after your liability limits are exhausted.

Ugh what? The surgery and Dr. bills alone lone are gonna cost that. Not to mention follow up Physical therapy.

And how do you know the person she hit doesn't need that hand to make living?

My daughter was in an accident and insurance determined she was at fault…she was not ticketed. I was expecting our premium to drastically increase, but it did not. In fact, at the next renewal it went down. I was surprised, but will take something going my way anytime. There was only vehicle damage and no injury claims…that might be the difference.

We use progressive.

How old was your daughter at time of accident? If she was 18, you are not likely liable for her negligence. Having her on your insurance policy means the other driver can make a claim against your insurance but not necessarily against you unless she was a minor at time of accident.

I was threatened with the same, and twice what I was insured for. I wanted to fight the claim, but Carrier ended up settling rather than court cost. It will settle, and you will pay more until the claim falls of of your record.

He never responded. But the point of the post as an example tool to people out there only carry minimum or low limits and how they are a spilt distracted second away from financial ruin.
