Multiple eyewitnesses from the train testified to being scared of the homeless guy, and felt that Penny was defending them/himself in a violent situation. The homeless guy had drugs in his system and had injured people on the train before (probably won't be allowed at trial).

At the root, it will be a defense of others argument. IIRC NY is a step into the shoes state with an obligation to retreat. Penny will have to show the person(s) he was defending had the right to use the level of force he used since he steps into their shoes legally. I said at the time of the incident the case will revolve around the testimony of the witnesses regarding the events that occurred prior to the video starting. The defense needs to establish the right to self-defense and the level of force the other individuals could use then it transfers to Penny when he intervened. States that put you in the shoes of the one you seek to defend are trickier than the ones that allow you to decide just with the facts you are confronted with.

And rightly so. Its not like Penny would have known that before jumping on him.
Just the basic facts of this case are enough to get all charges against Penny (rightfully) dismissed almost anywhere else. The fact that its in a far left state is the only reason there is even a debate here. Neely was acting like a psycho.

You see how the cops act in Portland and Seattle and NYC. It definitely changed my view of them.
The average police officer is, en masse, going to do what his politician and administrative bureaucrat tells him to do in order to get his check and go home, and there's absolutely zero historical reference to prove otherwise.
Among example after example, I watched officers of the state violate constitutional rights during covid because forcefully unemployed people on an empty beach dared to freely travel and dip their feet in the water.

Yeah, I’d imagine he doesn’t want to chance a trial verdict by 12 random New Yorkers. Prosecution doesn’t either. As much as most here hate them, they don’t want him being convicted of voluntary manslaughter, though they had to charge him with that if the grand jury came back with that true bill. I bet he pleads to something with time served plus some probation, and everybody tires to move on with their lives as quickly as possible with no more scrutiny on this as there already is.

Because intent to kill isn’t a required criteria for homicide and the ME doesn’t determine whether a homicide is justified or not, just that the manner of death meets the criteria for homicide. Plenty of homicides result in no charges.
