Overcharging is a travesty and the jury should not be able to convict on a "lesser crime" if the defendant wasn't charged with that.

Whats sad is this happens every day damn in this country. For the most part any charge you can think of gets this treatment.

My lawyer friend says this is a scummy tactic from prosecutors to make the jury feel "more comfortable" with agreeing on a lesser charge because they couldn't agree on the more severe one. Basically offer high and negotiate down.

WTF is this jury struggling? This is disgusting. He didn’t do anything wrong.

He subdued a dangerous man who previously punched an elderly lady in a subway. That man was threatening and looking to hurt people. Penny didn’t seek this out. He doesn’t deserve this.

How in the world could they even be in a deadlock?

I would never cave. Someone in the jury needs to stand for what is right. Penny doesn’t deserve any of this.

In fact, if I was the holdout on the jury, the dismissal of the more serious charge would only embolden me. Clearly the prosecution isn't confident in their own case so why should I be?
