Sankey’s/SEC pre-court brief

If tweet fails to load, click here. -SEC‘s argument is stating they can and require its members institutions to comply with SEC rules because Louisiana law says it can. Louisiana Supreme Court instructed court should not interfere with internal affairs of a private association unless it’s proceedings have not been conducted fairly and honestly where it’s conduct is fraudulent beyond it.
-They believe he cannot be held individually liable for conduct undertaken solely in his official capacity.
-They are arguing. The SEC is not an agent or functionality of the NCAA. And they are arguing that they did not coordinate or interact with the NCAA. They are saying that SEC is independent from the NCAA.
-The SEC has not and has no intention of imposing any penalty against the plaintiff in this lawsuit or any other lawsuits reference above or declaring any such plaintiff in eligible for competition in the SEC during the 2026 2027 year based on the violation of the professional rules and eligibility transfer rules
-These bylaws reflect that permitting former professional athletes to the return to competition also creates a competitive disadvantage in fundamental unfairness for current student athletes who have not pursued a professional sports career, but instead of maintain their commit to the college athletic model.

ADOPTION OF THESE BYLAWS REFLECTS THE INFORMED JUDGMENT OF OUR SEC MEMBER INSTITUTIONS TO PROTECT DISTINCTIVE CHARACTER OF COLLEGIATE ATHLETICS AND OPPORTUNITIES PROVIDED FOR CURRENT AND FUTURE COLLEGE ATHLETES. CONSISTENT APPLICATION OF THESE BYLAWS PROMOTES FAIR COMPETITION SUPPORT SOUND PROGRAM, PLANNING AND ADMINISTRATION ACROSS INSTITUTIONS AND CONFERENCES IN SUSTAINS THE DIFFERENTIATED PRODUCT THAT IS COLLEGE SPORTS.

Greg! We are trying to give spots to athletes who want to come back to school and better themselves athletically and academically because the NCAA told them they had to leave school last year!

He’s conveniently not addressing what is different about this year specifically and the omission of the 22 class from being included in this 5 for 5 deal.
How do you say your rule applies to every class except for that class, and then justify your position by saying muh high school?

If righteousness is all they have on their side rather than legal mumbojumbo then they have little ground to stand on... JMHO
