Because the toothless NCAA was barring them from play, not the conference. That makes a big difference.

My word, I hope you're not a lawyer.

At least one judge (in Texas, I think) has already modified the original order to include Sankey and the SEC as parties not allowed to interfere. Highly likely that same filing in the Louisiana case gets approved as well.

There is no party here that is untouchable, including the CFP.

Hey baws. Don’t shoot the messenger.

I would LOVE for LSU to play them with impunity.

If one of you legal bosses here can give me some authority that says so, I’m a happy boy. I’d be delighted to be wrong.

I just doubt it’s that clear. And when it’s murky, there is legal risk.

Is it worth it?

The LA hearing got pushed back from Monday 8/31 to Thursday 9/3

If that injunction is granted, then its game on.

All of you roody-poos who don't wanna see LSU improve their roster better be rooting hard for a stay next Thursday

You said teams have played people under injunctions with impunity. In those prior cases, the conference wasn’t a party.

No one, you included, knows how the Texas injunction plays out.

The actual party seeking the injunction is liable if they are shown wrong later. You think a third party like LSU has greater protection in relying on it?

I’d love to be wrong. Show me.

Ok? All we have to go on is what's happening around the country and all around the country, judges are siding with the aggrieved players and not the NCAA or any other organization trying to limit their ability to play.

Probably has something to do with the NCAA appearing to act in bad faith when the 2022 players were excluded from the 5 for 5 rule.

Crazy and strange things seem to happen to LSU.
At a later date during the season, I could his thing finally get ruled that NCAA/SEC can say players are ineligible if they go pro and get cut.
Then LSU getting in the playoffs while playing these guys as all this is fought in courts, win the national championship only to have media say the title should have an asterisks because they played ex pro players.

Publicly it would be a bad look for LSU. This stuff needs to be settled before games are played. I would sit back if i was LSU and not do a thing, not play any of these guys till it is settled.

If you obeyed an injunction while it was legally in effect, and the injunction is later overturned, your conduct during the injunction period was lawful because the injunction controlled what the parties were permitted or required to do at that time. The later reversal does not retroactively turn your compliance into a violation.

The Supreme Court has recognized that preliminary injunctions can materially change the parties' legal relationship while they remain in force.

Moscana is getting his info directly from lawyers. He had one of the main lawyers working the case for Luis in an interview yesterday. He explained a good bit. Look it up on youtube.

Okay. But LSU isn’t a party.

I was just talking about this. The NCAA was exposed with the entire Trinidad Chambliss debacle, they hold no cards and can't enforce shite. To those worried about vacated wins and suspensions... who's going to enforce them?

Now we're trying to throw rules together less than two weeks before kickoff that doesn't allow guys to play or else? Do I agree that once you declare you should no longer have collegiate eligibility, of course. But I think that in order to enforce the rule you can't just throw it in place on an "as needed" basis. These are things that should have been discussed and implemented long ago.

The NCAA deserves every bit of the repercussions and punishment they are going to get. The headaches, the legal fees, all of it. Been saying for a while now that all conferences need to secede from the NCAA, and this is why.

The entire premise of his rant is flawed because it wasn’t an ex parte hearing. The NCAA and the SEC were on a zoom call. They werent physically in the room but they were able to make their arguments. That snag is intentionally lying now because the Texas Group themselves replied to him and showed him the participants of the call.

I'm sure LSU's counsel is saying this behind closed doors. The legal risk far outweighs any potential gain from playing these guys. It's not as black-and-white as many want it to be.

I’m no lawyer, although my entire family is. I’m the dumb one, but in no basic common sense test does it seem legal or right to not let these guys play.

They meet all aspects of the new rule other than them all doing something they had no choice but to do (try to keep playing football at next level), based on not being informed of a new rule.

I truly don’t get how this is such a big deal. Yes, it’s strange, but how is it not fair?

Yep. And I’d bet good money there is a CYA letter from counsel in the file saying just that.

The one-man legal group is a big stretch.

This is going to a federal court and will be dead very quickly. These state courts, with hand picked knuckleheads deciding will be exposed very quickly.

Go ahead and play them, it seems like a great idea.
