You sir are not a judge

What is your analysis whether a third party is protected from the consequences of violating a rule while the enforcing organization is under restraint, particularly discussing consequences if the restraint is dissolved or overturned as wrongfully or improvidently decreed?
So you think the SEC is saying they will accept the courts decision, while still planing on holding up their “consequences” on the off chance it gets overturned AND the court rules their post decision penalties are even legal?

That’s new. I’d have to see exactly what they said.
A TRO expires after a few days. Is the SEC entering into a consent injunction?

Correct. I’m not a Holden either.

"The order entered against the SEC and Commissioner Sankey is a temporary restraining order, not a final ruling on the merits," the conference said in a statement. "The SEC and Commissioner Sankey are prepared to contest the allegations in the plaintiffs' petition at Thursday morning's hearing and defend the SEC's rights as a voluntary association to fulfill its mission to its member institutions."
SEC Still Intends to Punish
This is EXACTLY what I was worried about.

Injunctions get reversed all the time. And when they do in Louisiana, I don’t think they protect your conduct during the time they were in effect.
Probably should take "judge" out of your username and "lawyer" wouldn't be appropriate either. You can NOT be prosecuted or penalized for doing something legal at the time. IF the injunction is reversed, you WOULD be in trouble to then continue that action.

True dat.
A TRO does not protect us if we play them.
This could really eff up our system.
I thought earlier today the SEC was going to lay down, consent, and decline to appeal the PI. If that happens, play em.
Doesn’t look like that is happening.

You got some law on that? Would love to see it.
The party GETTING the injunction faces the consequences if it is reversed, even if it acted under the injunction. That’s 3608 in Louisiana, and I think it’s in the 680 range in Texas.
A third party would have even less protection.
But if you got some other law, do tell.

Often true.
What’s your analysis?

TRO that is later reversed will still protect you for that period of time it was valid, but thanks for your inaccurate legal opinion.
You got a cite for that? Cuz 3608 suggests otherwise.
Alabama basketball and Bediako. Zero penalties. Zero vacated wins. Zero sanctions. Thanks for playing.

That ain’t law, Clarence Darrow. And these matters are pending in Louisiana and Texas, right?
