I missed some of law folks’ live feed.
Did the jury get told they couldn’t watch the videos until key decisions are made about them?

They didn't ask for a mistrial without prejudice. They simply misspoke. Their filing was "with prejudice."
Sure didn’t sound like a misspeak. “We understand it will be without prejudice, but…”
It was my understanding the mistrial with prejudice was a separate filing.

Any chance they are using a prosecution tactic with their recent statement of without prejudice? I was watching when he said it and thought maybe he was playing a mind game with the judge. Judge has the motion of with prejudice, hears without said by the defense and rules on their motion without giving it second thought and it’s actually with prejudice? Would be sneaky but hell nowhere near the level of slime the prosecution has used.

They removed everyone from the courtroom and are allowing the jury to rewatch the 2nd drone video on the large TV in the courtroom.
Wait, so the Judge is allowing them to see the HD drone video that is in question and that the defense has filed a motion about?

there are two filed, on different issues: one with, one without.
Right on then. The only way I'd be asking for mistrial without prejudice in this case is if it was required for a point I wanted to make on appeal.

Quartering's on...cool.

This judge’s waffling back and forth is creating a huge mess. His inability to drop the hammer and make a decision is ridiculous

Judge issues instructions to jury: "No sitting in my chair."

Yep

I think the judge realizes there is no case for the prosecution. And he is trying to do everything he can to eliminate any claims for a mistrial by the prosecution and also come across as unbias.
It’s a dangerous game because the jury can see something there to change their minds in which case the judge will have to issue a mistrial or allow the case to work through the appeal process.

Nah
To me it sounded like a reluctant "Judge if you're not going to rule on our motion or deny it, we have no choice but to seek a mistrial without prejudice because it just isn't in our interest to roll the dice with this blatant evidentiary issue."
To me it seemed almost like a CYA by counsel, sort of a "we don't want to, but I don't think we can forego the opportunity in good conscience."

I thought the video they are arguing over is not the video the jury is watching

Checks out.
Damn. Approximately 59 posts a day for almost 18 YEARS.
That is pretty damn "impressive".
