I have a problem with unjust authority. Like a cop that arrests someone for giving him the middle finger or an HOA that won't let someone park their own work truck in their driveway. Of course the cop is worse because what he did was not only unjust but blatantly unconstitutional.

Conservatives are supposed to be champions of limited government. But most around here are not.

HOA has some rudimentary functions that must be covered.

1) maintain all common areas within the subdivision
2) insure all common areas
3) pay property taxes on all common areas

Condo associations are responsible for common roof of all buildings as well as other shared items.

After that it’s all subjective.

This doesn't seem reasonable and you may get a court to agree. HOA powers are limited by their purposes.


HOAs typically have a self help remedy. For example, if you don't mow your yard they can come in and do it and the fines would pay for that. The fines are tied to a real purpose of keeping up appearances which is a goal of the HOA.

But simply piling up fines in an amount where they would basically own the house and never address the appearance issues is outside the purpose of the HOA, especially since they are non-profit organizations.

I've lived in two neighborhoods in the past 19 years, both suburbs of DFW.

First One No HOA - Freaking shitty arse cars parked all up and down the street, people's yards knee deep in grass or barren with none, loud music and one family that got drunk every Sunday to watch the Cowboys. You could hear the MF'ers, GD's and every other curse word from five houses away.

True Story - My neighbor started buying boats (big ones with inboard motors) and would stay up all night sawing them up small enough for bulk trash to pick up. Freaking all night and 6 am on Saturday Sunday INSANE, saw saw saw saw.

I think the nut was buying them condemned then selling the trailers or something.


2nd House HOA - Clean, Quiet, everyone's yard is nice looking, no idiots making noise all night, peaceful, my blood pressure went down 100 points since moving. .

I bought one house with an HOA. Nosy people (in the early 90's before I knew to call them Karens) that constant watched everything people did. I'd come home from work to notes several times a month. Grass too long, grass dead, weeds in yard, truck parked in drive way too long, dog poop in front yard (didn't have a dog)... Vowed to never ever let people tell me how I should live on my own land again. Now I own 109 acres and do what I want when I want.

Elect better officers. Did you read the covenants for your subdivision prior to buying. HOAs can be good or bad. If you have someone that doesn't keep up their yards, home, outside buildings, etc., it effects everyone. I recently had to replace my roof and emailed my HOA president with my plans and he wrote a letter to the city's permit division. Now it's not a large fancy subdivision, but you HOA is only as good as the people you elect. There needs to be a recall provision in your HOA bylaws if they want to start acting like the gestapo.

I can't tell you how many complain in my neighborhood because they can't park their cars on the beautiful green spaces, or leave their RVs or boats in the driveway. They complain because they can't built huge work sheds in their backyard.

Everything that kept the neighborhood an attractive place to want to buy a home and the minute they sign the HOA agreement they start complaining.

I really like my HOA. If you get a bad one, odds are it was you failing to do any research before you bought it.

I’ve lived without them, and I’ll take a property with a good one all day long.

Got the hell out of my HOA neighborhood ASAP. Wife (no pics) and I bought 25 acres a hour outside Atlanta.

I had the temerity to stand up in a HOA meeting and tell the management company representative he should be fired for gross incompetence. He and the board decided to mandate a $450 iron mailbox in a neighborhood full of starter homes (think $135K in 2000). The $250-500K homes in the adjoining neighborhoods have simple wooden mailboxes that work just fine.
