In Texas at least a lot of HOAs are in unincorporated areas of the counties so there is no municipal government,

The problem is not HOAs the problem is the law firms that they contract with to enforce the code and the membership of the HOA instead of actually being citizen governance turns it over to law firms that make money by finding fault finding homeowners and seizing homes

Why do you feel the need to go beyond local government and control what someone can and can't do to their own property?

This must be a Texas thing. Not a single HOA does shite like that here. Hell the Board would be shot if they tried that here.

No, I don’t believe we should restrict the ability of landowners to contract as they see fit because you’re lazy and bad at real estate.

Because they agreed to abide by the CC&Rs when they signed the contract to their house.

If you don't like that, live somewhere else. Wife and I walked away from two other houses because of the stupid CC&Rs. It's not a hard concept.

Context clues must not work on you. Why would I have a realtor if I was a slumlord? I don't have any residential property for rent. I put the place up for sale as soon as the comptroller gave me the tax deed.

Uh, the monthly fee paid to the condo association is not an assessment. I'll bet there was insurance in place on the overall structure. I'll bet there was a landscaping contract. I could go on and on. How do you think that stuff gets paid for exactly?

And you realize that a condo association is just the representative of the unit owners, right? If you don't like condos, don't buy one. But without an association and the things they do there is no condo. There has to be a vehicle for maintaining the overall property and structure.

I have a lakefront condo as an investment property that will eventually be my base of operations in retirement while I travel. The HOA maintains the grounds, pool, and exterior of the building. Also, the units were originally apartments and they're not set up for individual water meters, so the HOA dues cover water and trash for the whole complex. It also covers the insurance for the structure itself, so I only pay for "walls-in" insurance. If a tornado rips the roof off of the building or the whole thing burns down, the HOA's insurance policy pays to replace the roof or rebuild the building. My policy just covers finish-out on the interior and belongings. There's really no other way to do it in my case. Fortunately, it's a small community and our HOA board isn't a bunch of assholes. If they becomes assholes, they can always be replaced.

You're a hypocrite. Government is what gave HOA's their existence and authority. You all cried to the government to have them. Why isn't it ok for me to cry for them to be dismantled.

Who the frick is going to pay for maintenance of public spaces? Landscaping maintenance? Pool maintenance if the community has one?
