You people still aren't understanding the problem. A new board can come in at any time and change what was once considered reasonable. They just stick "subject to change" in the documents and then you have no recourse without attorneys and large legal bills.
Unless he said so in a previous post, he didn't make that argument at all.
What I saw him say is what I said earlier. Don't buy in a neighborhood that has one and you don't have to worry about it. My wife and I intentionally moved to a neighborhood without one b/c we didn't want any of that. You can too.
Just like people have the right to choose to not be in one, though, people also have the right to voluntarily choose to form one/ to be in one.
Freedom encompasses both choices.

The sad truth is that it seems most Americans quite enjoy being burdened with bureaucracy and petty authority.
But again, that's their right. They should have the freedom to choose that just like you should have the freedom to choose otherwise.
We're not talking about an involuntary situation here.

The problem is people have bought a home not in an HOA and then later received notification that their home had been incorporated into one. To fight it they will have to put out thousands of dollars to hire an attorney and then likely not receive any compensation even if the judgement is in their favor. As stated earlier, most associations operate as a nonprofit. So what is the harmed homeowner supposed to do to recover legal fees? Put a lien on the entrance flower bed? These people did as you suggested and didn't purchase a home in an HOA. It's not ok any way you look at it.

But you all lose your mind at the thought of the government increasing individual freedom.
Personal freedom like consenting to give HOAs certain powers over you and your property?
