Would be interested in seeing all of the facts to this case. They accused them of harboring, which is 8 USC 1324(a)(1)(A)(iii) which says:
This seems more akin to them operating a stash house out of their bakery and not just employing people without work authorization.
Reasons the facts will be interesting is to see what they are considering to be harboring. Depending on how loosely they are using the term you could in theory be charged for renting a rental property out to someone who is illegal.

We have a small company in Alabama. We use e-verify. It costs nothing.

According to the complaint in the OP, the owners of the bakery knew they were illegal. They have witness statements from the illegals saying that the owners knew they were illegal and protected them on their property.
It doesn't look like they are going after employers that fell for false documents.

Truthfully, that was first wave migration stuff. They’ve gotten a lot slicker now.
My point is that, to my knowledge, there isn’t a law that clearly defines if an employer does e-verify, background checks, or whatever else that they are exempt from possible prosecution. It’s simply against the law to employ illegal immigrants whether a company does their due diligence or not.
And those that say it couldnt or wouldn’t happen, have never been on the receiving
End of an OSHA /EPA/IRS audit.
But if we are serious about prosecuting people why not prosecute end users of illegal imigration? Homeowners that use a roofing contractor w/ an illegal should go to prison as well

What does that even mean? My point was they deserves something for going the way of independent contactor but nothing is coming? There aren't any teeth out there to bite a private sector business for using contractors that are illegal that you really should be giving a 1099 to. The IRS sorta tried with the new 1099 rules that penalize you for not filing or doing backup withholding but what statutes are out there that will penalize a business for using illegals as an independent contractors? That is why so many businesses don't even think about making them W-2 employees. There may be some local or state laws related to your licenses or insurance but the repercussions for using an independent contractor that is an illegal are negligent.
My point is they need to use the W-9 process to require these verification services. Don't give businesses such an easy and painless out.
