From what I've read, the kid and his family have been taunting and harassing the pastor and their congregation ever since COVID when the pastor refused to stop providing religious services. Because he didn't, the taunting has been ongoing for years now with the final straw apparently being the kid (20yr old) yelling to the pastor that he was going to rape the pastor's wife
Here's the parents during one of the incidents. Apparently, the dad also said in an interview that an AK47 was the "solution" to dealing with the church.

Looks like the whole family could use some Pastor Tony attention.

Yeah isn’t the dad obligated to take a round to protect his son’s honor. Dude was in the camel clutch taking shots and screaming like a woman.

It is illegal to threaten to rape someone.

I'm definitely not a fan of Spell, he and that church are dickheads.
Years ago, not long after they opened the church, my brother and I were driving on Hooper. Had car trouble, it was an old sports car that needed some work. We pushed it into the parking lot, to get it off the street. Mind you, this was on a Tuesday at around 5:30 in the afternoon. We called another family member, our dad, who came out and who also called a tow truck (friend of the family).
As we were looking at the car and waiting on the tow truck, a deputy arrived. He said the church called the police and stated we cut the chain to the parking lot gate- which did not occur. The gate was open.
You could see someone looking out the doors of the church, who never approached us at all, to either see if we needed assistance (or to tell us to get off the property).
It was mind-boggling; Hooper was a 2 lane road then, busy rush hour traffic, and you could see us pushing a sports car off the road into the lot, and then lift the hood. And another car come, try jumping, and standing around looking under the hood.
This wasn't middle of the night, nobody was drinking or partying, nobody was offensive. And the people working on the car- a physician and an engineer. Just inside the lot off the road. I'm not a "what would Jesus do" guy, but I doubt he'd call the sheriff on us. I suspect Jesus would come out and ask if we needed help.
Tow truck came and one of us got in the truck with him as he loaded up the car, while the deputy looked at the lock and chain for signs it was cut (wasn't). Deputy to his credit was helpful and nice, said he was going to go talk to the pastor and the rest of us could leave.
frick them people if they still act like that.

You just answered your own question.
The threat doesn't require intent. I can't say that I'm going to rape your mom then say loljk.

I’m not sure it meets the legal definition of assault. If it did he’d have been arrested

And watching the video... Spell is stupid, arrogant and lucky to be alive.
He intentionally came onto someone else's property to fight them, and then pinned them down and continued to hit them.
Just speaking as a father- if someone came onto my property, and then did that to my adult son, and I was present, his wife becomes a widow. And zero attempt to mislead the police when they come- I'd say that guy came into our yard and was beating up my son. So I shot him to protect my son. Here's the gun I did it with.

Despite what our armchair lawyer UJB had to say, the pastor was first walking, then ran to get out of the road, and then walked up to the “kid”. Kid starts throwing punches, pastor beats him down. Probably enough still get the pastor in some trouble, but I would think the “kid” being threatening and showing this type of behavior for 5 years would be a factor in how this goes down.
Aside from legal, the “kid” got what he deserved. These kinds of people act like they do and continue to act like they do because nothing happens to them. Not this time, Junior.

He was never in their yard...

The pastor ran to the young man’s property and assaulted the kid - then after getting off of the kid and walking away and leaving the kid on the ground, decided he wasn’t done harming the kid yet and turns around to return and kicks the kid in the head while the kid is still on the ground.
That return and kick to the head should be an automatic attempted murder charge for this pastor.

Family releases new video of fight involving Pastor Tony Spell
Getting beat up by a pastor is unfortunate. But having your family release the replay package for the whole world to see is a whole different level of suffering.
If my 20-year-old son got folded up by a pastor, that footage would disappear faster than the Epstein list

No it doesn't, that's the ROW for the street, not their property.

This proves that you are an idiot. Try familiarizing yourself with public right-of-way which is where this altercation clearly took place.

Ok Karmelo.
The only demographic I share is gender.
So where did this fight occur? Spell left church property and crossed a busy road to go do this.
Was it at the Warthog Sharpener's lot or the Cracker Barrel, or maybe Central City Grill? But I'm seeing mailboxs nearby, I think it's a bit past them, so that makes it someone's home.
This is from the WAFB article
quote:
The neighbor told investigators that Spell started to walk across the road after he screamed profanities at him.
Officials stated that the neighbor was reportedly standing in front of his home.
If that's the case, then YES, Spell went to another man's property and attacked that man.
Since you call me "Karmelo", let's go on record with this- if someone comes to your home, fights your son in the front yard by the road, and is still beating on him while pinning him down, are you going to do something or not?
Me, I'm not going to fight. I'm going to say "get the frick off my property" as he comes, and if he chooses to escalate it I'm defending me and mine.
