The attack began when he was shoved down. That was a battery.

This case will hinge on when did the threat end....before or after the shooting.

If before he is guilty but if after then he walks.

per the video, in my eyes, it doesn't mean he was no longer a threat, but i think it clearly showed he was no longer a DIRECT and IMMEDIATE threat. There will always be what if's, but it was at that point you hold your weapon ready, but owe it to yourself to not fire away unless the threat becomes direct, eminent and inevitable again. and in that case, said attacker gets mowed down.

I've seen guys run from cops, put their hands in their air, or behind their back and laying on the ground even after being tased all look like they were "no longer a threat" at one point only to turn and try to take a cops gun and use it against him. I'm sure the decision to consider a violent attacker "no longer a threat" is much easier when you are watching a video in the comfort of your home than when you are the one confronting that attacker just steps away.

I think that shooter is going to jail. The guy assaulted the shooter but he was backing up when he got shot.

No, I would have to double check the statute, but I believe it uses the reasonable person standard.

This dipshit had an itchy trigger finger for awhile. He threatened other people over this spot and for other things. Hope the fricker rots, he isn't a self defense hero, but someone who will frick us out of gun rights.
