The attack began when he was shoved down. That was a battery.
This case will hinge on when did the threat end....before or after the shooting.
If before he is guilty but if after then he walks.

Don't illegally park in a handicap spot,
wait, are you saying parking in a handicap spot means you deserve to get shot?

How is one to come to a conclusion that he "not a threat" when he clearly just demonstrated the means and intent to cause bodily harm and in fact had already committed one such act.
because when he pulled the gun he backed away. You quoted the answer to your own question.

Did the guy just decide to shoot someone beause of where a car was parked?

How does that mean that he was no longer a threat?

He should 100% be found guilty, IMO.

1) He started the whole incident.
Um no. The person who violently attacked the other started the incident. Up until then it was an argument, a disagreement. At that point it became an assault.

2) He shot a guy who was backing away from him. That’s not self defense.
Was he backing off to pick up a club? Or maybe he was backing off to get his own weapon? Or maybe the person who just had the shite knocked out of him couldn't tell that he was backing off at all, because, you know... he just had the shite knocked out of him.

The guy is a POS and should do time.
Maybe. Maybe he's just an a-hole. Then again he didn't violently attack anyone.

If I get in a fight in Florida I’m gonna let you swing first and then murder you. Wtf?
Exactly. It's so ridiculous nowadays. People can't just get in a dang ol fist fight without someone resorting to the easy way out.

per the video, in my eyes, it doesn't mean he was no longer a threat, but i think it clearly showed he was no longer a DIRECT and IMMEDIATE threat. There will always be what if's, but it was at that point you hold your weapon ready, but owe it to yourself to not fire away unless the threat becomes direct, eminent and inevitable again. and in that case, said attacker gets mowed down.

Fortunately for society, that isn’t the standard.

I've seen guys run from cops, put their hands in their air, or behind their back and laying on the ground even after being tased all look like they were "no longer a threat" at one point only to turn and try to take a cops gun and use it against him. I'm sure the decision to consider a violent attacker "no longer a threat" is much easier when you are watching a video in the comfort of your home than when you are the one confronting that attacker just steps away.

I think that shooter is going to jail. The guy assaulted the shooter but he was backing up when he got shot.

No, I would have to double check the statute, but I believe it uses the reasonable person standard.

Absolutely. If you are too lazy to find a correct spot you are too lazy to contribute to society and must be purged.

6 down votes, but not a single response.

This dipshit had an itchy trigger finger for awhile. He threatened other people over this spot and for other things. Hope the fricker rots, he isn't a self defense hero, but someone who will frick us out of gun rights.

Yes you can, does the name George Zimmerman ring any bells.

Not a real case for stand your ground....his life wasn’t in danger.
Nevertheless if it had happened in Chicago no one would care.
