May have already been discussed but the video I saw on the news tonight shows the dick head right up at the woman’s car window.

No idea what he was saying but I’m not sure how I would react if I came out of a store to see some strange man screaming at my wife right at her window.

The push may have been justified, the shooting definitely wasn’t (in my opinion)

You're right.

You're right.

. It’s a fricking state of affairs that people like you think lethal force is the end all be all.

Maybe if dumbasses would quit picking stupid fights unprovoked that this wouldn't be the case?

quote:

You telling be that they couldn’t have just walked away from that?

Could they have? Sure.

But why is it the victim's responsibility to do that when he was attacked?

quote:

If you came out of the gas station and a man is in your wife’s face, how do you react?

If he's not physically attacking her, then I would not lay hands on him when I have no idea if he may have weapons or not and what he would do to win a fight.

The black guy, like a real fricking idiot, chose to do otherwise and it cost him his life.

Well, this isn't the standard.

I’m sure I don’t know what the standard is, but I have to think that the right to defend your life has to be in there somewhere.

I'm amazed how this people in this thread are just treating this like it's a UFC or boxing fight and any fight between random strangers on the streets should be a gentleman's fight.

Lawyers and bleeding hearts avoiding common sense. What else is new?

I disagree with that characterization of what is in the footage. It isn’t the greatest video, but I don’t see any sign of the attacker backing up until the guy produces the gun.

I think you should rewatch it. The victim shuffles his feet/adjusts his weight in the same position for a split second and is backing away while the shooter is reaching into his pocket. He takes at least two steps backwards before the shooter aims at him.

LINK

This is the video I’m watching. I’m looking specifically at the 0:29-0:31. It clearly shows the victim backing away before the gun is aimed at him.

quote:

If I were on the jury, all I would need to know is whether the shooter feared for his life, or if he just wanted to kill his attacker. The latter could easily be true, but you must give the shooter the benefit of doubt, because he was the only one in that situation.

I don’t think these are the instructions you’d be given as a juror. No reasonable person should be thinking “I’m about to die” in that scenario.

I mean, I kinda get where he’s coming from. It’s a little frightening that people in this thread think that it’s OK to blow someone away just because that someone shoved them...and moreover, those people decide criminal cases.

Read the statute and stop speculating. Do you have the right to defend your life by shooting someone who sneezes on you? If not, why not?

FYI, don’t clink the link unless you like putting money in Cenk Uygur’s pocket.

The video doesn’t help your position. Boyfriend is advancing on a-hole until he realizes he’s about to get smoked.

Having heard zero evidence. I like your style. Guilty until proven innocent. Unless you get a speeding ticket, traffic camera ticket or a DUI and then all of the sudden it is complete BS, right?

It also makes sure common sense has a role in whatever issue is being litigated in court.

Because intelligent people lack common sense so we need to have Joe Six Pack making serious decisions about things like murder.

In the last two to three pages you and Troy have:

Completely dismissed the concept of imminent threat

Totally misapplied the legal standard and changed it to “fear for his life.”

Confused assaults with batteries

Described misdemeanors as felonies

Substituted relaliation for prevention

And wholly mischaracterized the entire concept of Stand Your Ground

And that’s just the beginning of the list.

But I’m the crazy person who thinks that maybe it isn’t the best idea in the world to have twelve “common sense stuffed” Joe Six Packs making crucial, complicated legal conclusions in our criminal justice system.

I don’t give a damn about the statute. Just watched the video again, and yes, the man had every right to fear for/defend his life. Dude attacked him out of the blue and advanced on him.

Even if that were true (it’s not), he still fired on a guy that was retreating.

You can not spin this into a legit shooting no matter how much you skew what the video is showing.

Dude was defending his companion, which he actually has the right to do under the Florida statute.

Right, it should be decided by educated folks, like the judge who just released the fricks in New Mexico who were training school shooters, and ritually killed a 3 year old. If they flee and escape justice, the judge should take their place with their charges.

Why do the courts allow juries to inject common sense into decision making process of their verdicts?

If you think it's such a dangerous system, then you're free to run for office and make elimination of that system part of your platform.

Until then, you have to convince us joe six packs why this guy is evil and belongs in prison.

I'm not white knighting for the shooter but I won't be surprised if he's not convicted. It all happened in seconds and although the deceased does make a slight turn/back up motion I still don't think a jury will convict him. Just my two cents.

It's obvious, but you've ignored it.
