DEI strikes again.

Florida has a med mal cap on damages: She'll get a whopping $500,000.00
It looks like the 2023 law that set the cap is just on non-economic damages and might not even hold up in court. The Florida SC evidently ruled that caps were inconsistently enforced and not valid back in 2017.
She might get a decent bit more for economic damages, but you're right really. In the end, instead of getting slapped with a 100 million suit, Ascension will shrug off the loss and not give a shite. That same doc probably makes them several million a year.

When someone botches a surgery this badly, the video evidence should be made public. There was likely a series of failures that led to this terrible outcome.

You can get something called “wandering spleen” where you spleen moves around your abdomen. Even with that a spleen should look vastly different than a liver.

Terrible. Prayers for that poor woman.

Right, and in Texas, the Med Mal damage Cap is 250k.

I’d go all Ricky Ricardo on mine if it tried to pull that.

I know frickall about surgery, but was there not someone else there who could have spoken up when they started cutting on the wrong side of the body?

Sounds like another "Dr Death" scenario

Don’t think so. They go to the same type training as MDs. Four years and then residency I think. They can write scripts just like MDs.

Seems like they should have capped attorney fees, not actual damages...
