As soon as you mentioned the name of the employer in this thread you likely opened yourself up to legal action by them. What you’re describing sounds pretty damning but I’ve worked with employment lawyers multiple times in the past and if I’ve learned anything, it’s that there always seems to be things that appear pretty illegal that an employer can technically get away with so maybe there’s more to it than what your eye sees. I’m not going to quote the employer’s name, but if I were you, I’d go back and edit it out of your post. Just to be safe.

File an eeoc charge and then a title VII suit. You have enough to make out a prima facie case.
1. Member of a protected class (anyone)
2.qualified for the position
3. Despite your qualifications, you were not selected
4. The employer continued to hold the job open.
The employer will now have to articulate a legitimate non discriminatory reason why it selected you when the only thing that changed was the race box that you checked.

Maybe discovery would show that but on its face two similarly situated applicants received disparate treatment under the requisite “nearly identical circumstances.” See Carter v. Transportation Workers of America local 556.
The only thing between the applicants was the racial identification
