All you “right to assemble no matter what” folks...I assume you were equally up in arms when BLM protestors get arrested for assembling on roadways right?

Bc please explain to me the difference.

No one is stoping him from worshipping his god. But he is holding an unlawful assembly right now, does not mater if he is preaching the word or holding a kegger. Simply put this is beyond irresponsible for a “preacher”!

It will be interesting. I'm not sure Employment Division v Smith is analogous like boozie thinks but we will see


JBE’s emergency powers derive from statute, so I doubt they distinguish from Employment Division there. Statute may be ruled unconstitutional in whole, but I don’t think this guy gets any special deference because he’s a pastor. Employment Division is on point there.

The Right to Assemble is subject to a time, place, and manner restriction by federal and local government. Under our state laws, the governor, in declared an emergency, has the right to control ingress, egress, and gatherings. This allows him to place time, place, and manner restrictions on assemblies.

He has 30 days under the declared emergency until it has to be legally extended. At any time, the state legislature can convene and end a Governor's state of emergency.

There are no constitutional issues with this charge.

That's not a road you want to go down, see what I did there?

You can't block an accessway. BLM can protest on the side of the street all they want, which I support even if I don't agree with the message.

Why do you think a judge signed the arrest order idiots? He's violating the law.

I've never seen as many dumbasses as I've seen here. In states of emergencies, either local, state, or federal, there are emergency powers/acts enacted under existing emergency laws. If The Gov. of Louisiana or any other state has banned social gatherings/distancing guidelines then it is legal under state law to be charged. If it was under federal law, then could be arrested by federal authorities.

Anyone saying or thinking otherwise, had best research established case law. Both state and federal supreme courts have found such emergency declarations under state and federal laws as being legal and binding.
