Trial lawyers DON’T know federal law or procedure. That’s exactly why they generally avoid federal court. The dumbest thing the SEC could do is try to remove it (if they have diversity grounds) to federal court. The reason is that it invites a Sherman Aniti Trust claim—which they can’t win , would expose them to penalties and attorney fees.

I don’t even know how they would win in federal court. The conferences have been acting as an unsanctioned cartel. The NFL is able to exist because the government exempted it, this is not the case (yet) for college conferences, and why it’s necessary for Congress to act.

Surely you are not excluding the fact that local elected judges make decisions for personal gain or politics including for their reelections and not the law. 2 southern law judges are the ones making the local rulings including the father of another crappy and previously suspended local judge - Eboni. There is already a Federal case on this issue. There was a TRO issued by that court, but it was reversed on appeal. But the case is progressing in its lumbering way there. The issue of possible damages or a settlement will more than likely ultimately be decided there, but we are a long way from that stage. Everyone is hung up on eligibility right now, but this will ultimately be a case about money. Did the NCAA deny access to potential earnings for these players that they were entitled to receive by the NCAA's own rules?

Do we know if they pleaded federal antitrust claims or if they sued under Texas law.
It doesn’t specify in the order. Federal antitrust claims make moving it to federal court a real possibility but if they filed under Texas law, it’s got a much harder road to go federal.
If it stays in state courts this should be all but done.
ETA: I guess I got my answer from that tweet on page 1 that says “we aren’t making any federal claims”.
If that’s the case, then it will be much much harder to get into federal court, and I highly doubt that would happen. Which means it states of the state level in this should be all wrapped up.
