I think the fact that LSU did not roster Wright and Harris has everything to do with Axon's decision here as there is no longer a dispute over "illegal players" under the SEC's hastily contrived new rule. A trial may be inevitable unless one side or the other gives in. From the LSU side, that may involved serious penalties like suspending Kiffin and/or big fines. Heck, they may even want to prohibit LSU from post-season play. And for what?

The SEC shifted their cause of action away from the players in question when the court enjoined LSU to the plaintiffs in that case, meaning any punishment tied to playing the players would have been grounds for a suit itself.

Is not the SEC still holding its kangaroo vote on expulsion tomorrow? That to me is a big effing deal. The players and LSU had a cause of detrimental reliance regarding the two players in question. In general, courts view ex post facto rules such as the August 26 one as selective enforcement, a bill of attainder if you will. They cared nothing when the former NBA player joined Gump basketball.

They would have to show cause for sanctioning LSU. LSU did not do anything to warrant penalties from the SEC.

I think tomorrow will be the SEC begging LSU to accept some sort of penalty as a way to save a little face.

This League hearing tomorrow is completely separate from the Federal suit. And the lead anti - LSU attacks are coming from the Tenn. administration, the president being their mouth piece. And it's evident that she knows zip about the LSU brand / importance to the League.
