Not sure that matters. No matter why they did it. Now its federal, if reports are correct. This shite fiasco was unnecessary. Just no fricking reason to go this direction by LSU. As stated, im positive Kiff didn't do this without consulting the correct methods, before proceeding. Feels like someone at LSU will be the fall guy...maybe all the way to Verge himself. (I have NO knowledge of his level of participation)

If nothing else, you are a consistent little moron.

A federal court in Alabama cannot exercise jurisdiction over a Louisiana state institution (which is an extension of the State of Louisiana).

That is why Rousse, Ausberry, and Kiffin are named in their official capacities. Ex parte Young

LSU itself will get out on 11th amendment immunity.

But that case isn't going anywhere anyway.

Even presuming to, the conduct did not occur in Alabama.

Their attorney will argue that they were working for the State .

They'll say they "just attended unpaid minicamp(s)" and never "signed a contract".

Which is a clear demonstration of a choice to "move on from college athletics" (Sankey's words, not mine).

As long as the other teams get to keep their “pro” players then Hunt can go frick himself.

I can't imagine the judge is going to be happy about that if he finds out

If you read between the lines, the federal suit is asking for the federal court to enjoin the Louisiana court from holding the SEC in contempt. The state court judge WILL NOT be happy about that.

Hunt saying LSU should wave the white flag.

This represents a pretty significant misunderstanding of legal process. LSU isn't the one pushing the issue, the SEC is. LSU and LK now have to defend themselves and they should avail themselves of all remedies available (inclusive of countersuit).

The argument will be that it does because of LSU's membership in the SEC, and that the conduct being *allegedly* restrained would occur in Birmingham. But it could lead to a transfer of venue I suppose.

And the counter will be Ex Parte Young, i.e. that a state official can be sued in his official capacity in federal court if he is violating federal law (here, that would be the ridiculous first amendment shite the SEC is spinning).

Bottom line SEC argument fwiw: Louisiana may be able to declare these guys eligible to play college football, but Louisiana cannot force the Southeastern Conference to accept LSU playing them under our banner while preventing us from enforcing our own rules.

I just don't see a situation where the judge doesn't hold them in contempt. But I am not a practicing attorney lmfao

Yes, but the conduct restraining is is Louisiana.

If this survives a 12b6, it will be transferred to MDLA

Which are? Sankey couldnt even define what a professional athlete is. How can they enforce a rule with no clear definition?
