Nike won a temporary restraining order that halted the sales pending further, more permanent court decisions to come (i.e. possible permanent injunction, judgement for damages, etc.).

But never let the trust stand in the way of a sensationalistic headline ("Nike wins lawsuit!!!")

Exactly. Protecting their trademark. I don't like Nike, but Nike was in the right in this case.

While it definitely could have been concocted as marketing ploy, MSCHF has already made custom shoes in the past, so having to actually make the shoes is not a problem. They made a limited edition Jesus Shoes line in 2019 that sported biblical references and had Holy Water from the Jordan inside.

And Lil Nas X just had a charting single, so he’s not exactly fading. Though he has an album coming out that he certainly could want to drum up more publicity for.

Most likely MSCHF was eager to make custom shoes associated with a hit rapper and Lil Nas X just wanted to make edgy shoes which he pretty much all but admitted anyway (bc of his spite for the religious who spurn him)

It was apparently a base nike shoe that this "MSCHF" bought as a plain white version then modified to incorporate satan apparently? Nike said they had nothing to do with the design/creation of these and thus the lawsuit. Nike's IP are the swoosh and their original shoe in this instance.

No, but they have a trademark on the Nike Swoosh logo.

Lots of negative PR and backlash about the shoe and the Nike logo on it makes people assume that Nike created or sanctioned the shoe, not realizing it was a custom version created and resold by a 3rd party. So Nike sued to protect their image and branding. frick Nike for all their SJW pandering bs, but I agree with them on this case.

How is this different compared to someone buying some cars, modifying them and then reselling them? Does this judgement mean they have to get permission from manufacturers if they leave the badges on?

He did an interview on the Ticket in Dallas a couple years ago, and the dude was pissed that they don't play the Twist on the radio anymore. Because, in his words, it was the biggest, best selling, and all around best song in the history of the music business, but for some strange reason he can't hear it on the radio anymore.

Will be an interesting conversation as custom shows like this have become a big thing. And they certainly haven’t fought to protect it in many many examples

This just being an temporary, while the case plays out, means it doesn’t effect anything buuuuuut the implications associated with a future ruling could be more interesting and far reaching than most in this thread actually considered it seems
