Two of them owe their careers to affirmative action and the bastard stepchildren of it IMHO.

Kagan isn’t someone I like but I think she at least knows the law. I am not sure about the other two.

I agree. I just wish this doesn't open things up for more foreign students. Americans First should have access to improve our nation not take it back home to Chyna or find a way to stay here.

Also, I hope this starts to get quotas in the job market to go away as this garbage goes deep in the workplace.

Someone in TX can confirm specific, but they have a top class % rule that guarantees the top X% of good and bad schools get into any state school.

I wonder if a rulling here will affect that rule.

That rule was implemented as a way to get around the then-current cases prohibiting consideration of race in admissions, because the legislature and the flagship universities wanted to increase minority representation in their student bodies.

I do not see any reason that would change.

The schools can prefer all sorts of things other than race. There is nothing controversial about that.

I listened to part of the arguments today. It was amazing that nobody was addressing the 1,000,000 pound elephant in the room. These people are just completely f*cking delusional. Even the conservative justices didn’t state the f*cking obvious that was proven in the original Michigan cases. They were all acting like affirmative action is just there to “break ties."

As the Michigan cases showed without any doubt, we’re not talking about breaking ties. We’re not even talking about breaking somewhat close differences. We're not even talking about differences in the same f*cking universe. Affirmative action establishes a completely different set of criteria for minorities, and in particular for blacks. Most of the black students accepted in the Michigan cases wouldn’t have even gotten a second look in a race blind admission process. These black applications would’ve been summarily "thrown in the f*cking garbage" while the admissions committee laughed and wondered why did this idiot waste his f*cking money.

But, listening to the arguments today, you would’ve sworn that being black just gives applicants a very slight edge and is mainly used to “break ties.”

It is this kind of delusional and demented thinking that allows such a blatantly racist and unconstitutional institution like affirmative action to go on for over 50 f*cking years and several generations of students.

It was also interesting to hear the lawyer representing UNC lie like a motherf*cker and say that UNC is just trying to follow past Supreme Court precedent and will one day follow the Michigan case and end its Affirmative Action policy despite knowing that UNC never plans to get rid of its affirmative action policy. Alito and Thomas really made him look like a complete lying f*cking moron on this issue. No one in that courtroom today believes that UNC has any plans to ever give up it’s affirmative action program. Yet that scumbag UNC lawyer tried to pretend like there may come a day when UNC will not need an affirmative action program. He couldn’t give them a date or even a time frame but did all but admit that it would not happen within the 25 year period set forth in the Michigan case that is set to run its course in 2028.

Finally, one of the more interesting answers that I heard today was by Biden's Solicitor General. She was advocating for affirmative action on behalf of the military academies. When pressed about setting up an affirmative action program based upon socioeconomic considerations, she actually stated that if they were to do that, then studies have shown that the people who would benefit the most from that system are poor white men -- LIKE THAT WOULD BE THE MOST HORRIBLE F*CKING RESULT IMAGINABLE. In making this “argument," this stupid f*cking c*nt did nothing short but admit that it is poor, white men who are the ones who suffer the most from affirmative action. So, in her delusional, demented, and deranged mind, blatantly and racistly discriminating against poor white men in favor of mostly rich black applicants is perfectly acceptable. Of course, this f*cking c*nt would tell you that those poor white men are "privileged" vis-a-vis those poor and deprived rich black applicants.

SCOTUS is going to frick us right before the midterms aren’t they? Get the minorities to turn out in droves and a built in “excuse” as to why the Dems win the midterms so they can explain the fraud away when minority districts turn out 110%

The problem is the language of Title VI of the Civil Rights Act.

When you use race to grant acceptance to a limited pool you necessarily deny admission to another based on their race.

The other criteria you noted don't explicitly violate that. There will always be disparate impact arguments on the criteria used, but a college should not be able to make decisions based on race. Even in situations where it's done in favor of a historically underprivileged race.

No discrimination based upon race should mean no discrimination regardless of race in question.

Yes. These are all variables that can help determine if the student will be a good fit there and be a positive addition to the University

Because race doesn’t tell you anything about the persons character, work ethic, ability to pay for college, etc. Its a physical characteristic.

The left believes minorities aren’t capable of competing at a high level to get in college without affirmative action and lower standards to get them in.

The fact is without AA colleges would become much whiter and Asian dominated. Why? Because whites and Asians value education and have a culture that promotes family and education. They get involved in schools and make sure their kids go to a good high school. This leads to kids getting into college.

That said, if we continue to make it easy for minorities to get into college they have no reason to try to do better. No incentive to fix the schools in inner cities or push their kids to do better. We are doing a disservice to these kids because they get to college racking up debt and they are woefully unprepared for any real courses or degrees that would yield a positive return on that investment. So we create bullshite degrees so they can finish college. So they rack up 10s of thousands in debt they’ll never be able pay back to receive a useless piece of paper and still end up making 40k a year at a job they could have gotten out of high school. Now you have a student loan crisis and a bunch of young adults who will never get ahead financially. It’s decimating to minorities and it’s simply a government system designed to create more and more dependent citizens rather than productive ones.

Take people based off merit regardless of race. Initially yes due to our broken system this will weed out a ton of minorities, but over time you’ll see it start to improve as minorities start doing what is necessary to compete, and it will fix a lot of problems we currently face.
