This is a national emergency to protect the borders of the nation. That is a Constitutional duty.

I don’t really see him going around congress because congress passed legislation to build a border wall years ago. Trump is just declaring an emergency to actually fund the building of said wall.

OK replace guns with medical care for everyone, everyone, and the GOV is going to pay for it all. Cmon, this is pandora's box and will not pass the scrutiny of the legal system and a majority of the American people. The REF A it will establish for future Presidents, of any party, is horrible.

One of the few things that the Fed should do is protect our sovereign borders. Congress doesn't seem to want to do that so the CIC is going to have to take care of this for them. I don't see a problem.
ETA: There are way too many people with way too many guns for anything other than the Dems getting slaughtered if they try it.

And, it's absurd to think that if some future Dem thinks he could get away with what OP suggests that he wouldn't try.

Does it not freak you out that the USSCT will ultimately determine whether this is an emergency or not?
Trump could affirmatively win that issue, but as it would be a constitutional question of separation of powers. Even if the Ct rules that Trump has the authority to do this (which I actually believe that he does), if the language in the opinion is broad enough- it could grant the POTUS the ability to grant any issue the POTUS thinks is important as a national emergency.
AOC and company have already declared that they think global warming is an emergency on par with WWII and somehow socialism and Medicare for all is the cure. No it makes no sense - but if Trump wins, I think its actually more dangerous than if he loses.
