Title insurance??

That's the whole purpose of it
Title insurance would simply ensure the original title was free and clear for the legit owner when he attained it

Exactly.

Has to be a crime ring. No way this one woman is anything but a name/face for the operation.

Which illustrates why the notion that this is some sort of rampantly spreading “issue” everyone should be super concerned about is silly. You basically have to identify yourself to the world that you are committing a clear crime to do this.

Not necessarily. This person was only caught because she was dumb enough to contact the HOA for a showing. If she had sold the house to an investment group or foreigner without needing a walk through, she would have had the money before anyone knew it was a con. Or if she tried to steal a home that wasn't in an HOA or gated community.

There's a former conman on YouTube that talks about how easy it is to steal homes this way, but his name escapes me. He says that most clerks are required by law to file the paperwork even if they know the document is shady.

"There's no effort to authenticate the validity of the change of deed," Adams said. "Nobody verifies who owns the house that's trying to be transferred to a different owner."

Adams promptly presented evidence of his ownership, including mortgage and tax documents, but county officials informed him that they were powerless to intervene.

This should be no more than a 4 hour investigation to straighten out and put someone behind bars. A legal transfer of real estate has an easy document trail to all parties involved and all sources of funds.

Either the system will stop shite like this or we'll just have to do it ourselves

Agree.

You know who doesn't have problems with their homes being stolen? Mafia bosses, that's who. There's a reason.

Nothing would ever get recorded of a clerk had to stop and research every filing. In my experience it’s difficult to even track down a notary to check signature logs.
you missed my point

the deed had to be filed by someone in the clerk’s office

i assume that someone would be required to sign the document and accept payment of fees

therefore that person’s identity should be known to investigators

no research necessary, just ask the clerk a couple of questions, namely:

were you acquainted with Ms. Mangum prior to her deed application?

did you assist her in any way with obtaining the documentation required to file the claim?

if so, were you compensated in any way by Ms Mangum for this assistance?

i find it difficult to believe that someone with presumably little or no experience in committing fraud could walk in off the street and claim property worth $4.2 million without someone advising her what she needed to pull it off

Over and over again you price what an idiot you are

If I own a home and there is an invader - care to expound on what the law is????

We will wait - dolt

Carolina law :

quote:

when the new defensive force statutes were passed), a person had the right to use deadly force to prevent or terminate an unlawful, forcible entry into the home in the same circumstances. Under both formulations, a person relying on defense of habitation was claiming that he or she was defending against a wrongful entry.

Disagree, we've seen many times that there are plenty of people who are above the law

We lean on a system that is not only corrupted but weaponized against us

Why the hell should anyone play along willingly?

How are they powerless to stop a blatant case of fraud?

Not relevant.
She did not take occupancy. She fraudulently took title.

They are not lawyers or judges and most of the time not capable of making the determination.

This is the same thing with LEO and squatters. They're not Judge Dredd and if they frick up, they will get their department sued bigly for breaking the law.
