I think this sets wildly dangerous precedent for leftists to interpret the constitution however they feel is emotionally right rather than what it says. You don't have to like birth tourism to admit that the actual wording allows for noncitizens to birth citizens. How you wrote it is exactly how we end up litigating "common sense gun control," which we both know is bullshite. It's the Trump quote "sounds good, doesn't work."

The original spirit and intent of the law MUST be inherently considered because that is the basis for the law itself.

If Congress wishes to expand that, they have the power to call a convention and add/subtract as necessary.

SCOTUS’ job is not to extrapolate the Constitution, it is to INTERPRET the Constitution.

Extrapolating the coverage and scope of the Constitution falls on Congress on behalf of the people.

I understand and agree with people's issues with birthright citizenship, and what it encourages. I also think it needs to be closed, fully.

But this power resides with the do nothing shite pieces in Washington DC, both sides.

If they wanted this issue resolved, they'd pass legislation.

Illegal migrants lower wages for unskilled workers (up to a 5% decrease for high school dropouts). Oddly enough, there are estimates of driving down the wages of native college graduates by 2%.

They drive up housing costs. They are free riders in our EMTALA healthcare system. Their children are free riders on our education system.

I’m not sure if you agree with me and are just expanding or what.

Interpreting the constitution to not grant citizenship to the children of illegal immigrants would be extrapolating.

And at the time we may not have had illegal immigrants but we had lots of immigrants and not everyone liked them. So they had to know those kids would be getting citizenship.

If there wasn't a "no questioning of the justices" limitation placed on lawyers who are presenting this birthright citizenship challenge to the SCOTUS this hearing would be over in short order with one question to every justice.

"What was the original intent and purpose of the 14th amendment?"

If every justice had to honestly answer that ^^^ question the hearing would have already ended and birthright citizenship would also ended.

What limits are on birthright citizenship? Somebody can step across the border, shite out a kid 5 minutes later, and that kid is an American citizen with no restrictions.
