I think that's one of the contentions of Lake's team (ie: that there was a high chance of fraud due to lack of CoC, then backed up by the existence of wrong-sized ballot, thus saying that the wrong-sized ballots were put in during the CoC lapse). The burden of proof is on Lake's team as they are the ones making the charge (as the defendant the elections board/county/whomever is considered innocent until proven guilty).
All that said, they did a solid job of creating the foundation yesterday for proving this. If they have 19-inch ballots and enter those into evidence, this case is over and the election is thrown out (this is due to the county/elections office reps stating flat-out there were no non-20-inch ballots used, nor could they be used).
