Could he have dismissed?
The question is of course rhetorical, EVERYONE knows he could have.
There are probly' more than a FEW cases in this judges' history where he let some pieces of zhit off the hook because of personal bias, having a bad day, etc.
But make NO mistake, this woman was going to PAY for having the NERVE to stand up for freedom and not licking the boot.....
This was POLITICAL on the part of the judge, he had the authority to drop the whole thing...

Incidentally, something being overlooked in this thread is that it was the Texas Supreme Court that slapped this bitch judge in Dallas down.
These judges’ (and the OP’s) ire is somewhat misplaced.

The judge issued a temporary restraining order upholding the governor's order to close.
If the judge had said, forget this, I'm not going to uphold that white man in Austin's order and will deny issuing the restraining order, would've meant he wasn't doing his job (and get this) would've gotten the wall-eyed state attorney general to criticize him for a whole other reason.
This is all political and it's coming out of Austin.
And whomever said that businesses are just going to open up now and ignore everything, was exactly right.
The governor will have his stupid little press conference Tuesday about how we gotta do this and gotta do that to get to phase 2 or whatever, and he's going to look like a total idiot because he's undercut his own authority to kiss up to certain factions of his party, one of which is this woman's attorney.

When you publicly rip up a court order and say, "frick you, Greg Abbott, Judge Jenkins and Judge Moye," I would say that's definitely contempt. Then she doubled down in court with another middle finger extended
I can see your pretty melty about this —I hope you are at least as bothered by the fact that the Dallas DA wont prosecute theft under $750. That’s a real law he’s ignoring too by the way —and unlike this salon owner—theft actually hurts other people.
