And even that conversation would be sloppy as hell…

This isn’t a functional alcoholics might slip by unnoticed situation - it’s that a normal persons falling down and the hardcore alcoholics just seem drunk

I've had two, one while working for a local city in central Arkansas and one as a US Marshal. In both instances the breathalyzer was an "add-on" to the random drug tests and didn't require any suspicion, just your name to be drawn randomly that testing period.

To put it in more plain terms - about 6 to 8 people (out of 50+ in my department) would be selected for random drug screens and out of those, 2 or 3 would also have to take the breathalyzer along with the pee tests. It was completely random every time as far as those that had to pee in a cup for drug testing, but then those 6 to 8 names were also put into the hat and chosen randomly to blow in the breathalyzer.

The 3 times out of dozens of chances to be chosen randomly for drug screens that I've had, I had to blow in the breathalyzer once.

Probably TMI, but this will give a little backstory to those wondering why a company/management would breathalyze someone they don't suspect of any wrongdoing

I was working on a Chevron project years ago and they were treating it as if it was already offshore and on any given week I would have to do a breath test 2-3 times a week since I was one of the commuters. Oddly the only people I can recall failing were Chevron employees. None of the contractors ever failed.

You lose about .015 BAC per hour. If you blew a .249 and then retested later you'd take .249-(.015xH) where H is the number of hours between tests. As others have said, it'll take a good bit of time to blow 0.0 BAC from .249, so a good argument can be made that the first test was flawed.

Nope. They gave him a reason he was fired (a failed blood alcohol test). If he really took a test within an hour and it proved he wasn’t then he will win.

In at will states you should never give a reason they were fired. All that does is open yourself up to a suit.

If this is a real situation, what legitimate manager wouldn't hear a result like that and look at the employee closely. You would be able to tell right away. And what Manager wouldn't want to hear a second test before firing the person?

They were okay with him leaving, assuming he was driving, after blowing three times the legal limit?

That’s also absurd and possibly a liability issue in and of itself .

So, maybe. One of the people I'm talking about who maxed out the machine I didn't clock as intoxicated at all before he was tested. After I knew the results and paid closer attention, it was kind of like "yeah, I guess his eyes are a little glassy and he's slurring a little bit...". But steady on his feet, coherent, etc. And I say that as someone who has spent hours upon hours watching DWI BWC video. I knew what I was looking for and still didn't see much.

But you have to be straight up pickled lever alcoholic to reach that point. Again, only seen it once in over a decade.

Heavy drinkers can blow that the next day after drinking. But they def would have had other issues that prob would have led to a test because they are heavy drinkers.

The odd part to me is that they tested him at work. Anytime I’ve been pulled for a random I had to go to the third party clinic within the hour to do the drug/alcohol screen.

Sounds like he’s taking the fall for some shitty upper management or they just needed an excuse to get rid of him to replace with DEI hire

Meh. If they made him take a breathalyzer and he failed, and they fired him on the spot, the reason is obvious.

Rubbing alcohol residue in the mouthpiece? Could that cause the false positive? Though I would imagine they're supposed to use a new sterile mouthpiece for testing.

Corporate oil in gas.. office worker .. random drug test done daily for employees . you would usually get called in once every six months.. when called your supervisor would have to come tell you and you had a one hour time limit to report to the medical office. If failed you stayed in the room until a security officer came to walk you out of the building.
