A couple in India have said they are "delighted" after a court ordered a hospital to hand over the frozen semen sample of their dead son to them so they could have a grandchild through surrogacy.

The landmark Delhi High Court order came after a four-year legal battle.

“We were very unlucky, we lost our son. But the court has given us a very precious gift. We would now be able to get our son back,” the mother, Harbir Kaur, told the BBC.

Ms Kaur and her husband Gurvinder Singh petitioned the court after Delhi’s Ganga Ram Hospital in December 2020 refused to release their son’s semen which was stored in their fertility lab.

The couple’s 30-year-old son, Preet Inder Singh, had been diagnosed in June 2020 with Non-Hodgkin’s Lymphoma - a form of blood cancer - and admitted to the hospital for treatment.

She added that the family was considering using his sperm in surrogacy and that a relative had agreed to be the surrogate. “We will keep it in the family,” she said. Under Indian law commercial surrogacy is illegal.

No wonder why Raj Koothrappali moved to Los Angeles, and hid amongst nerds to escape India's caste system and his overbearing parents.

Other than the surrogate needing to be a relative, that’s actually a pretty good way to honor the son’s legacy. It’ll be the closest one could get to having their dead relative back.

Whole thing's a bit creepy, but I don't have a problem with it.

They are already both in their 60s. The sisters said they would care for kid if something happens to parents, but it seems to be a little selfish without regards to affect on kid as well as irresponsible. Deaths happen and grandparents have raised their grandkids, but this is planned from before the kid even exists with back up plan of sisters dividing up his care like a hot potato. They later mention it was also about carrying on the family name which I guess can’t be done with daughters making me wonder if they are going to abort until they get a male.

I would understand if a wife wanted to have a kid using her dead husband’s sperm, or maybe when grandparents would at least still be in their 40s at the time of birth.

Not really.

This also makes me wonder what happens if baby is a girl.

that the order would help them preserve a connection with him and help their family name to continue.

Don’t see the problem here. If it can be done why not?

They will have a child that looks similar to their dead son but he won’t be their son who died.

Raising a newborn is hard enough when you are young. Taking on the care of an infant at age 60 is not for the faint of heart.

Well, they’ll probably be gone before they have a chance to go through this again.

I understand the loss of a family member, but we can’t bring them back.

Too many emotions guiding this.

I don’t have a problem with that, just like I wouldn’t if he was married and the wife wanted the sample. It shouldn’t have took 4 years, my child, and my child dies without a wife or children then that sample belongs to his parents. Plain and simple. India, America, it doesn’t matter.

Don’t Hindus believe in reincarnation? If that’s their bag, I guess I can see the logic.
